<br />September 8. 2009 <br /> <br />Discussion: <br />. The purpose of the Residential Anti-Displacement and Relocation Assistance <br />Plan is to provide procedures for the replacement of all occupied and vacant occupiable <br />low-, moderate-and middle-income (LMMI) dwelling units that are demolished or <br />converted to a use other than as LMMI dwelling unit as a direct result of activities <br />assisted with funds provided under the Housing and Community Development Act of <br />1974. <br />. The City proposes to use NSP funds to purchase foreclosed properties, <br />rehabilitate the properties, and sell them to LMMI households. The City has agreed to <br />limit its NSP purchases to vacant foreclosed properties and has further agreed to <br />rehabilitate the properties with no plans to demolish properties. <br />. Federal regulations, however, require that procedures be in place should the use <br />of NSP funds by the City result in the need to replace and occupied or vacant <br />occupiable dwelling unit that is demolished or converted to a use other than as a LMMI <br />dwelling unit. <br /> <br />Financial Impact: <br />. There is no local match requirement for the Neighborhood Stabilization Program. <br />The City has no intentions of purchasing occupied units with NSP funds nor does the <br />City plan to demolish vacant occupiable dwellings requiring use of funds for relocation <br />of households or replacement of dwelling units. <br /> <br />Staff Recommends: <br />. Adopt the Program Income Plan for the NSP project. Vision Principle: Thriving <br />Neighborhoods and a Sense of Community. <br /> <br />Next Steps Following Council Action: <br />. Submit the Anti-Displacement and Relocation Assistance Plan to DHCD. <br /> <br />Motion by Ms. Randall, and seconded by Mr. Whitehurst, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"RESOLUTION ADOPTING A RESIDENTIAL ANTI-DISPLACEMENT AND <br />RELOCATION ASSISTANCE PLAN FOR THE CITY OF PORTSMOUTH'S <br />NEIGHBORHOOD STABILIZATION PROGRAM PROJECT. <br /> <br />WHEREAS, the Virginia Department of Housing and Community Development <br />(DHCD) awarded the City $2,000,000 in federal Neighborhood Stabilization Program <br />(NSP) funds to purchase and rehabilitate residential properties that have been <br />foreclosed upon and to resell them to income-eligible parties; and <br /> <br />WHEREAS, federal regulations require that procedures be in place should the <br />use of NSP funds by the City result in the need to replace an occupied or vacant <br />occupiable dwelling unit that is demolished or converted to a use other than as a low, <br />moderate, or middle income dwelling unit. <br /> <br />WHEREAS, DHCD requires that the City adopt a Residential Anti-Displacement <br />and Relocation Assistance Plan ("Plan"); and <br /> <br />WHEREAS, the City Council has reviewed the proposed Plan, a copy of which is <br />attached hereto and identified as Exhibit A. <br /> <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia that it approves and adopts said proposed Residential Anti-Displacement and <br />Relocation Plan and directs the City Manager or his designee to send a copy of this <br />resolution to the Virginia Department of Housing and Community Development along <br />with such other documents and assurances as may be required and are in the best <br />interests of the City of Portsmouth." <br />
