September 8. 2009 (b) CP-09-01 DOWNTOWN - The City of Portsmouth seeks to amend the Destination 2025 Comprehensive Plan to address development in the downtown area. The Comprehensive Plan recommends the creation of a detailed Downtown Master Plan to specifically define land use and development strategies for the City. Vision Principle: Bold New Directions. There were no speakers. Motion by Mr. Whitehurst, and seconded by Ms. Psi mas, to concur with the recommendation of the Planning Commission that CP-09-01 be approved on first reading, and was adopted by the following vote: Ayes: Heretick, Psi mas, Randall, Smith, Whitehurst, Holley Nays: None (c) UP-09-10 CHURCHLAND - Supat Adalem requests a use permit to operate a restaurant at 5774 Churchland Boulevard. The Comprehensive Plan Future Land Use Map recommends Commercial Development in the area. Vision Principle: A Robust and Prospering Economy. There were no speakers. Motion by Mr. Heretick, and seconded by Ms. Randall, to concur with the recommendation of the Planning Commission that UP-09-10 be approved on first reading, and was adopted by the following vote: Ayes: Heretick, Psi mas, Randall, Smith, Whitehurst, Holley Nays: None - Unfinished Business - 09 - 440 - Use permit: Motion by Mr. Heretick, and seconded by Mr. Whitehurst, to adopt the following resolution approved on first reading at the August 25, 2009 meeting, and was adopted by the following vote: 09-440: "RESOLUTION GRANTING A USE PERMIT (UP- 09-11) TO OPERATE ENTERTAINMENT ESTABLISHMENT AT 509 AND 511 HIGH STREET. WHEREAS, David L. Griffin, Sr., has made application pursuant to Section 40- 43.1 of the Code of the City of Portsmouth, Virginia (2006) for the granting of a use permit for the operation of an entertainment establishment at 509 and 511 High Street, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of the application for a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That it finds that the use for which the permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use;
