<br />September 8. 2009 <br /> <br />At a Regular Meeting of the City Council on Tuesday, September 8, 2009, there <br />were present: <br /> <br />Mayor James W. Holley III, Charles B. Whitehurst, Sr., Marlene W. Randall, Stephen E. <br />Heretick, Elizabeth M. Psi mas, Douglas L. Smith, City Manager Kenneth L. Chandler, <br />City Attorney G. Timothy Oksman. <br /> <br />Pastor Gene Primm, opened the meeting with prayer, which was followed the <br />Pledge of Allegiance to the Flag. <br /> <br />Mayor Holley called the meeting to order and welcomed all in attendance. <br /> <br />Motion by Mr. Whitehurst, and seconded by Mr. Heretick, to approve the minutes <br />of a Called Meeting of August 24, 2009, of a Called Meeting of August 25, 2009, and of <br />a Regular Meeting of August 25, 2009, and was adopted by the following vote: <br /> <br />Ayes: Heretick, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />09 - 457 - Presentation: <br /> <br />. Presentation of special lapel pins to newly appointed board and commission <br />members. <br /> <br />- Public Hearing - <br /> <br />09-458 <br /> <br />Public hearing on the proposed adoption by the City Council of a resolution <br />(a) securing the City's payment obligations in the maximum amount of <br />$77,798,292 under a sale and development agreement providing for the <br />development and sale to the City of courthouse facilities (the <br />"Development Agreement") with a pledge of the City's full faith and credit <br />and, if required, a deed of trust on the City's property located at 801 <br />Crawford Street, Portsmouth, Virginia and (b) authorizing the City to issue <br />general obligation bonds, or notes in anticipation thereof, in the estimated <br />maximum principal amount of $76,000,000 to finance, in part, the City's <br />payment obligations under the Development Agreement. <br /> <br />1. Steve Carroll, 3112 Riveredge Road, spoke in opposition to this item. <br /> <br />2. Mark Geduldig-Yatrofsky, 2713 Sterling Point Road, spoke in opposition to this item. <br /> <br />09 - 459 - Public hearing on code amendment, comprehensive plan and use permit <br />applications: <br /> <br />(a) CA-09-04 <br /> <br />DOWNTOWN - The City of Portsmouth seeks to amend Chapter 40 <br />(Zoning Ordinance) of the City Code to address new design <br />standards and processes for the Downtown District. The <br />amendments apply mainly to the Downtown D-1 District and the <br />Downtown Design Committee. The Comprehensive Plan <br />recommends that the City adopt guidelines that address downtown <br />design issues. Vision Principle: Bold New Directions. <br /> <br />1. Terry Danaher, 413 Dinwiddie Street, spoke in support of this item. <br /> <br />2. Tony Goodwin, 38 Linden Avenue, spoke in support of this item. <br /> <br />Motion by Ms. Psimas, and seconded by Ms. Randall, to concur with the <br />recommendation of the Planning Commission that CA-09-04 be approved on first <br />reading, and was adopted by the following vote: <br /> <br />Ayes: Heretick, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br />
