<br />AUQust 11. 2009 <br /> <br />At a Regular Meeting of the City Council on Tuesday, August 11, 2009, there <br />were present: <br /> <br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psi mas, Douglas L. Smith, <br />City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman. <br /> <br />Reverend Larry Ugarte' opened the meeting with prayer, which was followed by <br />the Pledge of Allegiance to the Flag. <br /> <br />Mayor Holley called the meeting to order and welcomed all in attendance. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Whitehurst, to approve the minutes <br />of a Called Meeting of July 27, 2009, of a Called Meeting of July 28, 2009, of a <br />Regular Meeting of July 28, 2009, and of a Called Meeting of August 5, 2009, and was <br />adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />09 - 415 - Presentation: <br /> <br />. Presentation of 2009 Office Accreditation Plaque to the City Treasurer's Office. <br /> <br />'" Mayor Holley offered an apology for recent events. <br /> <br />- Public Hearing - <br /> <br />09 - 416 - Public hearing on code amendment, rezoning and use permit applications: <br /> <br />(a) CA-09-02 <br /> <br />CITYWIDE - The City of Portsmouth seeks to amend Chapter 14 <br />(Flood Protection) of the City Code. The Comprehensive Plan <br />recommends that the City continue to participate in the National <br />Flood Insurance Program, enforce the Floodplain Ordinance, and <br />pursue policies to minimize the risks of flood damage. Vision <br />Principle: A Robust and Prospering Economy. <br /> <br />There were no speakers. <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Smith, to concur with the <br />recommendation of the Planning Commission that CA-09-02 be approved on first <br />reading, and was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />(b) CA-09-03 <br /> <br />CITYWIDE - The City of Portsmouth seeks to amend Chapter 9.1 <br />(Chesapeake Bay Preservation Area Overlay District) of the City <br />Code and make appropriate recommendations concerning the <br />adoption of amendments that will facilitate the development <br />process in the City of Portsmouth. The Comprehensive Plan <br />recommends that the City implement strategies that preserve, <br />enhance, and restore the natural features and environment. Vision <br />Principle: A Robust and Prospering Economy. <br /> <br />There were no speakers. <br /> <br />Motion by Ms. Randall, and seconded by Mr. Heretick, to concur with the <br />recommendation of the Planning Commission that CA-09-03 be approved on first <br />reading, and was adopted by the following vote: <br />
