September 26, 2000 <br /> <br />00-219(a): <br /> <br />"A RESOLUTION GRANTING A USE PERMIT TO KHAYAL SAEED FOR THE <br />OPERATION OF A CONVENIENCE FOOD STORE WITH GASOLINE PUMPS AT <br />4408 WEST NORFOLK ROAD. <br /> <br /> WHEREAS, Engineering Services, Inc., agent for Khayal Saeed, the owner of <br />the subject property, has made application pursuant to Section 40-43.1 of the Code of <br />the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate a <br />convenience food store with gasoline pumps (S.I.C. 54 and 554) at 4408 West Norfolk <br />Road, Portsmouth, Virginia; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting the <br />application for an amended use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br />1. That the use for which the permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br /> driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That Khayal Saeed is hereby granted a use permit pursuant to Section 40- <br />43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a <br />convenience food store with gasoline pumps on property located at 4408 West Norfolk <br />Road, and being more particularly described as: <br /> <br />UP-00-14 <br /> <br /> Beginning at a point 322'+ west of the intersection of West <br />Norfolk Road and the Norfolk, Franklin and Danville Railway; <br />thence, in a westerly direction 610'+ to a point; thence, in a <br />northerly direction 242'+ to a point; thence, in an easterly direction <br />391'+ to a point; thence, in a southerly direction 146'+ to a point of <br />the beginning. <br /> <br />3. That the use permit is approved subject to the following conditions: <br /> <br /> (a) The project shall be constructed in accordance with the submitted site and <br />landscaping plans, as approved, identified as Exhibit A and made a part hereof. <br /> <br /> (b) The project shall be constructed in accordance with the submitted building <br />elevation, as approved, identified as Exhibit B and made a part hereof. <br /> <br /> (c) All signage must receive design approval from the Director of Community <br />Quality and Planning Services prior to on-site placement. <br /> <br /> (d) Additional landscaping shall be provided along the perimeter of the <br />parking area and must be approved prior to application for or issuance of a building <br />permit. <br /> <br /> <br />
