September 26, 2000 00-219(a): "A RESOLUTION GRANTING A USE PERMIT TO KHAYAL SAEED FOR THE OPERATION OF A CONVENIENCE FOOD STORE WITH GASOLINE PUMPS AT 4408 WEST NORFOLK ROAD. WHEREAS, Engineering Services, Inc., agent for Khayal Saeed, the owner of the subject property, has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate a convenience food store with gasoline pumps (S.I.C. 54 and 554) at 4408 West Norfolk Road, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting the application for an amended use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Khayal Saeed is hereby granted a use permit pursuant to Section 40- 43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a convenience food store with gasoline pumps on property located at 4408 West Norfolk Road, and being more particularly described as: UP-00-14 Beginning at a point 322'+ west of the intersection of West Norfolk Road and the Norfolk, Franklin and Danville Railway; thence, in a westerly direction 610'+ to a point; thence, in a northerly direction 242'+ to a point; thence, in an easterly direction 391'+ to a point; thence, in a southerly direction 146'+ to a point of the beginning. 3. That the use permit is approved subject to the following conditions: (a) The project shall be constructed in accordance with the submitted site and landscaping plans, as approved, identified as Exhibit A and made a part hereof. (b) The project shall be constructed in accordance with the submitted building elevation, as approved, identified as Exhibit B and made a part hereof. (c) All signage must receive design approval from the Director of Community Quality and Planning Services prior to on-site placement. (d) Additional landscaping shall be provided along the perimeter of the parking area and must be approved prior to application for or issuance of a building permit.
