<br /> At a Regular Meeting of the City Council on Tuesday, September 26, 2000,
<br />there were present:
<br />
<br />Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., P. Ward Robinett, Jr.,
<br />J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., City Manager
<br />Ronald W. Massie, City Attorney Timothy Oksman.
<br />
<br /> Vice Mayor Bernard D. Griffin, Sr. opened the meeting with prayer, which was
<br />followed by the Pledge of Allegiance to the Flag.
<br />
<br />Mayor Holley called the meeting to order and welcomed all in attendance.
<br />
<br /> Motion by Mr. Moody, and seconded by Mr. Whitehurst, to approve the minutes
<br />of a Called Meeting on September 11, 2000, a Called Meeting on September 12, 2000,
<br />a Regular Meeting on September 12, 2000, a Called Meeting on September 18, 2000,
<br />and a Called Meeting on September 20, 2000, and was adopted by unanimous vote.

<br />00 - 232 - Presentation:
<br />
<br />Proclamation presented to Dr. Kenneth St. Andre', Portsmouth Health Director, for
<br />"Prostate Cancer Awareness Month".
<br />
<br />- Public Hearing -
<br />
<br />00 - 233 - Public hearing on a code amendment and rezoning applications:
<br />
<br />(a) CA-00-03
<br />
<br />CITYVVlDE - The City of Portsmouth requests a Code Amendment
<br />to modify Use Schedule Tables 40-43.1-1 (Residential Districts),
<br />40-43.1-2 (Commercial Districts), 40-43.1-3 (Downtown Districts)
<br />and Condition 18 of the Zoning Ordinance to clarify the criteria for
<br />accessory dwellings.
<br />
<br /> Motion by Mr. Moody, and seconded by Mr. Whitehurst, to concur with the
<br />recommendation of the Planning Commission that CA-00-03 be approved on first
<br />reading, and was adopted by unanimous vote.
<br />
<br />(b) Z-00-05
<br />
<br />HIGHLANDS NEIGHBORHOOD - The City of Portsmouth requests
<br />to rezone a 102 acre parcel from Commercial C-2, Residential RM-
<br />60, and Residential RM-75 to Business Park BP. The site is
<br />bordered by Cavalier Boulevard to the north, McLean Street to the
<br />east, Greenwood Drive to the south and Victory Boulevard to the
<br />west.

<br /> Motion by Mr. Robinett, and seconded by Mr. Whitehurst, to concur with the
<br />recommendation of the Planning Commission that Z-00-05 be approved on first reading,
<br />and was adopted by unanimous vote.

<br />Consent Aqenda
<br />
<br />00 - 219 - Use permit and code amendment applications:
<br />
<br /> Motion by Mr. Benn, and seconded by Mr. Griffin, to amend item (a) to include
<br />the restrictions to preclude the sales of single containers of beer or malt liquor, and was
<br />adopted by an unanimous vote.
<br />
<br /> Motion by Mr. Benn, and seconded by Mr. Moody, to adopt the following
<br />resolution and ordinances as amended, approved at the September 12, 2000 meeting,
<br />and was adopted by the following vote:
