<br />July 14. 2009 <br /> <br />WHEREAS, there is an extremely urgent design and construction schedule for <br />the new bridge, and it is imperative for the new bridge to have prompt assurances that it <br />will in fact obtain all needed property interests to build and operate the bridge in <br />Portsmouth, and Portsmouth wishes to provide those assurances on reasonable <br />conditions, <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That the City Attorney shall determine what property interests are needed <br />from the City of Portsmouth in order for the new bridge to be built and operated. In <br />making that determination, the City Attorney shall protect the interests of the City and <br />shall retain such easements andlor property rights as may be necessary for all <br />reasonable present and future operational needs of the City. <br /> <br />2. The City Attorney shall prepare a Cooperation Agreement with the <br />Portsmouth Redevelopment and Housing Authority by which the City will convey said <br />property interests to the Housing Authority for the purpose of having the Housing <br />Authority convey them to the private owner of the new bridge, in accordance with <br />Virginia law concerning property transfers by public entities. The terms of conveyance <br />shall require the grantee to pay fair compensation for said property interests. <br /> <br />3. The property interests authorized by this resolution may include, as <br />necessary and without limitation, conveyance of fee simple title, permanent easements, <br />temporary easements, air rights, and licenses. <br /> <br />4. The City Manager is hereby authorized and directed to sign all <br />agreements and instruments of conveyance reasonably necessary to implement the <br />intent of this resolution. <br /> <br />5. The City Attorney and City Manager are authorized to take all such further <br />actions and provide all such further written instruments and assurances as may be <br />reasonably necessary to implement the intent of this resolution, which is to facilitate the <br />prompt construction of the new bridge while also protecting the interests of the City of <br />Portsmouth and its citizens. <br /> <br />6. The City Attorney and City Manager shall keep City Council timely <br />informed of all actions they take to implement this resolution. <br /> <br />7. This resolution shall take effect on the date of its adoption." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />09 - 369 - Adoption of a resolution authorizing an amendment to the Law Enforcement <br />Mutual Aid Agreement between the City of Portsmouth and various Cities, Counties, <br />and the Town of Smithfield. Vision Principle: Bold New Directions. <br /> <br />Background: <br />. For many years, Law Enforcement agencies throughout the Hampton Roads <br />region have entered into Mutual Aid Agreements to authorize inter-jurisdictional <br />assistance and cooperation. The proposed agreement merely updates prior <br />agreements by adding several other regional jurisdictions. <br />
