<br />July 14. 2009 <br /> <br />Discussion: <br />. The localities that will be parties to the agreement are Chesapeake, Franklin, <br />Hampton, Newport News, Norfolk, Poquoson, Portsmouth, Suffolk, Virginia Beach, <br />Williamsburg, Accomack County, Gloucester County, Isle of Wight County, James City <br />County, Northampton County, York County, and Smithfield. <br />. The agreement authorizes voluntary inter-jurisdictional assistance and <br />cooperation between law enforcement agencies. <br />. The law enforcement agency of the host locality will remain in charge of all <br />criminal investigations and prosecutions within that locality's jurisdiction. <br /> <br />Financial Impact: <br />. No material financial impact. <br /> <br />Recommended Action: <br />. Adoption of the resolution IS recommended. Vision Principle: Bold New <br />Directions. <br /> <br />Next Steps Following Council Action: <br />. Manager to sign Agreement. <br />. Agreement to be implemented by the Portsmouth Police Department. <br /> <br />Motion by Mr. Heretick, and seconded by Ms. Randall, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"RESOLUTION AUTHORIZING A LAW ENFORCEMENT MUTUAL AID AGREEMENT <br />BETWEEN THE CITY OF PORTSMOUTH AND VARIOUS CITIES, COUNTIES, AND <br />THE TOWN OF SMITHFIELD. <br /> <br />BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the <br />City Manager is authorized and directed to sign a Law Enforcement Mutual Aid <br />Agreement that is substantially the same as the one attached to this resolution and <br />identified as Exhibit A. <br /> <br />BE IT FURTHER RESOLVED that the City Manager is authorized and directed, <br />without the requirement of further Council action, to execute any future amendments to <br />said Law Enforcement Mutual Aid Agreement that add or delete parties thereto but do <br />not amend, add to, or delete the other provisions set out in Exhibit A. <br /> <br />BE IT FURTHER RESOLVED that this resolution shall take effect on the date of <br />its adoption." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />- New Business - <br /> <br />09 - 370 - Boards and Commissions <br /> <br />Mr. Moody offered the following nominations: <br /> <br />Hampton Roads Transportation PlanninQ OrQanization <br /> <br />Elizabeth M. Psi mas to be appointed to fill a two year term ending June 30,2011, as an <br />Alternate member. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Heretick, to close nominations, and <br />the above nominations were adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br />
