<br />May 26. 2009 <br />Motion by Mr. Whitehurst, and seconded by Ms. Randall, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"RESOLUTION GRANTING CONDITIONAL APPROVAL FOR EMERGENCY <br />MEDICAL RESPONSE, LLC, TO PROVIDE CERTAIN TRANSPORT SERVICES <br />WITHIN THE CITY OF PORTSMOUTH. <br /> <br />WHEREAS, Va. Code S15.2-955 provides that no organization shall provide <br />emergency medical services without the prior approval by resolution of the local <br />governing body; and Virginia Administrative Code regulation 12VAC5-31-420 also <br />requires that any applicant for licensure by the Virginia Office of Emergency Medical <br />Services include such local approval in its state license application; and <br /> <br />WHEREAS, Emergency Medical Response, LLC., a private business (herein <br />"Center"), desires a state license to provide certain medical transport services in the <br />City of Portsmouth, Virginia; and <br /> <br />WHEREAS, the Chief of the Portsmouth Department of Fire, Rescue and <br />Emergency Services (the "Fire Chief') has determined that Center has appropriate <br />trained staff and equipment to properly provide said services; now therefore <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. Approval to provide certain medical transport services is hereby granted to <br />Emergency Medical Response, LLC, subject to the following mandatory conditions while <br />operating within the City of Portsmouth: <br /> <br />a. Emergency Medical Response, LLC shall limit its transport business to non- <br />emergency transports at all times when operating within the City of Portsmouth. <br /> <br />b. Emergency Medical Response, LLC may not attempt to provide service to, nor <br />shall it respond to, emergency situations (commonly known as "911 Calls") unless <br />requested by an authorized official of the Portsmouth Department of Fire, Rescue, and <br />Emergency Services (the "Department"), or through a written agreement with the <br />Department. <br /> <br />c. If Emergency Medical Response, LLC learns of an emergency situation while <br />engaged in the normal course of business, it shall promptly report same to the Dispatch <br />Center operated by the Department, and it shall thereafter follow all directives of the <br />Department. <br /> <br />d. By accepting this approval, Emergency Medical Response, LLC acknowledges <br />and agrees that the Department is the only designated 911 agency authorized to <br />provide emergency services and emergency transport. <br /> <br />e. Emergency Medical Response, LLC shall timely pay all federal, state, and local <br />taxes, shall obey all applicable federal, state, and local laws and regulations, and shall <br />keep all its transport vehicles and medical equipment in a safe, neat, clean, well- <br />maintained, and sanitary condition. <br /> <br />2. The Fire Chief is hereby authorized by City Council to enforce the terms of <br />this resolution. If the Fire Chief determines that there has been a material violation of <br />any provision hereof, or any other conduct that places public safety or the public interest <br />at risk, he shall report it to the Virginia Office of Emergency Medical Services and shall <br />thereafter cooperate with said Office in any investigation. <br /> <br />3. This resolution shall take effect on the date of its adoption." <br />
