May 26. 2009 Motion by Mr. Whitehurst, and seconded by Ms. Randall, to adopt the following resolution, and was adopted by the following vote: "RESOLUTION GRANTING CONDITIONAL APPROVAL FOR EMERGENCY MEDICAL RESPONSE, LLC, TO PROVIDE CERTAIN TRANSPORT SERVICES WITHIN THE CITY OF PORTSMOUTH. WHEREAS, Va. Code S15.2-955 provides that no organization shall provide emergency medical services without the prior approval by resolution of the local governing body; and Virginia Administrative Code regulation 12VAC5-31-420 also requires that any applicant for licensure by the Virginia Office of Emergency Medical Services include such local approval in its state license application; and WHEREAS, Emergency Medical Response, LLC., a private business (herein "Center"), desires a state license to provide certain medical transport services in the City of Portsmouth, Virginia; and WHEREAS, the Chief of the Portsmouth Department of Fire, Rescue and Emergency Services (the "Fire Chief') has determined that Center has appropriate trained staff and equipment to properly provide said services; now therefore NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. Approval to provide certain medical transport services is hereby granted to Emergency Medical Response, LLC, subject to the following mandatory conditions while operating within the City of Portsmouth: a. Emergency Medical Response, LLC shall limit its transport business to non- emergency transports at all times when operating within the City of Portsmouth. b. Emergency Medical Response, LLC may not attempt to provide service to, nor shall it respond to, emergency situations (commonly known as "911 Calls") unless requested by an authorized official of the Portsmouth Department of Fire, Rescue, and Emergency Services (the "Department"), or through a written agreement with the Department. c. If Emergency Medical Response, LLC learns of an emergency situation while engaged in the normal course of business, it shall promptly report same to the Dispatch Center operated by the Department, and it shall thereafter follow all directives of the Department. d. By accepting this approval, Emergency Medical Response, LLC acknowledges and agrees that the Department is the only designated 911 agency authorized to provide emergency services and emergency transport. e. Emergency Medical Response, LLC shall timely pay all federal, state, and local taxes, shall obey all applicable federal, state, and local laws and regulations, and shall keep all its transport vehicles and medical equipment in a safe, neat, clean, well- maintained, and sanitary condition. 2. The Fire Chief is hereby authorized by City Council to enforce the terms of this resolution. If the Fire Chief determines that there has been a material violation of any provision hereof, or any other conduct that places public safety or the public interest at risk, he shall report it to the Virginia Office of Emergency Medical Services and shall thereafter cooperate with said Office in any investigation. 3. This resolution shall take effect on the date of its adoption."
