<br />At a Regular Meeting of the City Council on Tuesday, April 28, 2009, there were
<br />present:
<br />
<br />Mayor James W. Holley III, *William E. Moody, Jr., Charles B. Whitehurst, Sr., Marlene
<br />W. Randall, *Stephen E. Heretick, Elizabeth M. Psimas, Douglas L. Smith, City
<br />Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman.
<br />
<br />Reverend Johnnie Hinton, Sr., opened the meeting with prayer, which was
<br />followed the Pledge of Allegiance to the Flag.
<br />
<br />Mayor Holley called the meeting to order and welcomed all in attendance.
<br />
<br />Motion by Ms. Psimas, and seconded by Ms. Randall, to approve the minutes of
<br />a Called Meeting of April 13, 2009, of a Called Meeting of April 14, 2009, of a Regular
<br />Meeting of April 14, 2009, of a Called Meeting of April 16, 2009 and of a Called Meeting
<br />of April 20,2009, and was adopted by the following vote:

<br />Joint public hearing with the Portsmouth Redevelopment and
<br />Housing Authority to solicit citizen comment on the 5 year
<br />Consolidated Plan and the Annual Action Plan, the adoption of the
<br />Conservation Plan for the Truxton Conservation Project and the
<br />reaffirmation of the Redevelopment Plan for the Cradock
<br />Redevelopment Project.

<br />. City Manager Kenneth Chandler introduced the new Fire Chief Don Horton.

<br />09 - 198 - Use permits:
<br />
<br />Motion by Mr. Whtiehurst, and seconded by Mr. Smith, to adopt the following
<br />resolution approved on first reading at the April 14, 2009 meeting, and was adopted by
<br />the following vote:

<br />"RESOLUTION GRANTING A USE PERMIT TO HOLIDAY HOUSE OF
<br />PORTSMOUTH, INC., TO EXPAND A GROUP HOME FOR CHILDREN AT 4211
<br />COUNTY STREET.
<br />
<br />WHEREAS, Dan E. Griffin, AlA, P.C. has made application on behalf of
<br />Holiday House of Portsmouth, Inc., pursuant to Section 40-43.1 of the Code of the City
<br />of Portsmouth, Virginia (2006) for the granting of a use permit for the expansion of an
<br />existing group home for children at 4211 County Street, Portsmouth, Virginia; and
<br />
<br />WHEREAS, the applicant and the Planning Director have done all things
<br />required to be done in connection with said application; and
<br />
<br />WHEREAS, the Planning Commission has recommended the granting of the
<br />application for a use permit with conditions.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
<br />Portsmouth, Virginia:
