<br />March 24. 2009 <br /> <br />2. That a housing use permit for the construction of up to 234 residential <br />apartment units at 4358 Greenwood Drive is hereby granted to New Bethel <br />Development, LLC, subject to the following terms and conditions that shall be observed <br />by the applicant and any successor in interest: <br /> <br />a) The housing project shall be limited to 234 apartments. <br /> <br />(b) All rents shall be at market rate. <br /> <br />(c) The applicant shall design and construct the development In accordance to <br />the site plan and elevations dated November 10, 2008. <br /> <br />(d) Any changes to the approved plan must be reviewed and approved by the <br />Planning Director or designee prior to final site plan approval. <br /> <br />(e) All parking spaces and parking lots shall be developed In accordance with <br />all City Code requirements for size, number, and landscaping. <br /> <br />(f) All units shall be built in such a manner that they will be condominium <br />convertible. <br /> <br />(g) Prior to the issuance of a Demolition Permit, a Certificate of Abatement must be <br />obtained. <br /> <br />(h) The applicant shall be responsible for the cost of establishing and/or <br />upgrading the necessary utilities. <br /> <br />(i) The applicant shall adhere to the Solid Waste Management Plan approved by the <br />Department of General Services. <br /> <br />(j) All taxes and fees associated with the proposed project shall be paid. <br /> <br />(k) The establishment shall be built and managed in compliance with all <br />applicable codes and ordinances and regulations of federal, state and local <br />government. <br /> <br />(I) Certificates of occupancy shall be issued for no more than 164 units prior <br />to the construction of the Community Center and the installation of the landscaping. <br /> <br />(m) The site shall include the following improvements which shall be installed prior <br />to the issuance of any certificates of occupancy: <br /> <br />3. EXPIRATION OF PERMIT: Unless extended as provided under Section <br />40-115 of the Code of the City of Portsmouth, Virginia (2006), the housing use permit <br />shall expire for any portion of the approved project for which building permits have not <br />been issued if the applicant fails to apply for all building permits for the entire project <br />within two years of the adoption of this resolution. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the permit by the City CounciL" <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />- City Manager's Report - <br /> <br />09 - 160 - Adoption of an ordinance appropriating the sum of $750 in the FY 2008-2009 <br />Behavioral Healthcare Services Fund to fund a portion of the Guardianship Costs for <br />individuals with intellectual disabilities.
