432 November 27, 1998 90-429 NON AGENDA SPEAKERS: (a) Bill Watson, 200 Gee Street, representing the Highland-Biltmore Civic League requested information on whether the CIP pro3ects for the Highland-Biltmore area would still be implemented or if they would be reduced or deleted as reported by the newspaper in order to fund jail renovations. Mr. Orton advised Mr. Watson that staff had not reported back to him or to Council with any recommendations yet. (b) Richard K. Fitzpatrick, 403 Summers Place, representing the Highland-Biltmore Civic League requested information on whether drainage problems in the Highland- Biltmore area would be addressed or cut from the CIP. (c) Bill Watson, 200 Gee Street, representing the Highland-Biltmore Civic League, asked that senior citizens and handicapped person be given priority for business loans. - UNFINISHED BUSINESS - CONSENT AGENDA Mayor Webb requested that item 90-450 (c) the consent agenda to allow for a speaker, and removed. be removed from the item was thus LaVern Abernathy Theus, 217 Median Circle, representing self, spoke and thanked Council for their previous support of her use permit application and asked for their additional support in passing the permit on final reading. 90-450 (c) Motion of Mr. Clemons and seconded by Mr. King, the following resolution, approved at the Regular Meeting of November 13, 1990, was adopted on final reading and by the following vote: "A RESOLUTION GRANTING A USE PERMIT TO LAVERN A. THEUS TO OPERATE A CHILD DAY-CARE CENTER AT 217 MEDIAN CIRCLE. WHEREAS, LaVern A. Theus has made application pursuant to Section 40-75(b) of the Code of the City of Portsmouth, Virginia, 1988, as amended, granting a use permit tQ~operate a child day-care center at 217 Median Circle; and WHEREAS, the applicant and~the~Planning~Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has irecommended- the~' granting of said use permit, with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: That the use for which the use permit hereinafter described is sought: (a) will not adversely affect the health and safety 'of persons residing or working in the neighborhood of the proposed use;
