<br />March 10. 2009 <br /> <br />At a Regular Meeting of the City Council on Tuesday, March 10, 2009, there <br />were present: <br /> <br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psi mas, Douglas L. Smith, <br />City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman. <br /> <br />Reverend Gene Primm opened the meeting with prayer, which was followed the <br />Pledge of Allegiance to the Flag. <br /> <br />Mayor Holley called the meeting to order and welcomed all in attendance. <br /> <br />Motion by Mr. Whitehurst, and seconded by Mr. Smith, to approve the minutes of <br />a Called Meeting of February 24, 2009, and of a Regular Meeting of February 24, 2009, <br />and was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />- Public Hearing - <br /> <br />09 - 137 - Public hearing on use permit, housing use permit and code amendment <br />applications: <br /> <br />(a) UP-08-12 <br /> <br />VICTORY COMMERCIAL DISTRICT - Troutman Sanders LLP <br />requests a use permit to operate a food store with gas sales, <br />eating place with seating and gasoline service station at 3706 <br />Rapidan Street, 3709 and 3711 Victory Boulevard. The <br />Comprehensive Plan's Generalized Future Land Use Map <br />recommends Commercial Development. Vision Principle: <br />Thriving Neighborhoods and a Sense of Community. <br /> <br />1. R. J. Nutter, 222 Central Park Avenue, Virginia Beach, spoke in support of this <br />item. <br /> <br />2. Barbeta Terry, 909 Darren Drive, spoke in support of this item. <br /> <br />Motion by Mr. Moody, and seconded by Ms. Randall, to concur with the <br />recommendation of the Planning Commission that UP-08-12 be approved on first <br />reading, and was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />(b) HP-09-02 <br /> <br />FORMER BONNEVILLE SITE - New Bethel Development, LLC <br />request a housing permit to construct 234 apartments at 4358 <br />Greenwood Drive. The Comprehensive Plan's Generalized Future <br />Land Use Map recommends multifamily residential development. <br />Vision Principle: Bold New Directions, Thriving Neighborhoods <br />and a Sense of Community. <br /> <br />1. Veronica Moody-Johnson, 166 Yorkshire Road, asked that City Council defer this <br />item until she resolves the issue of a 1 % placement fee she believes she is owed <br />by New Bethel Development <br /> <br />2. Mike Holley, 711 Crawford Street, voiced his concern with the number of recently <br />approved rent controlled developments and the affect it could have on businesses <br />within the City. <br /> <br />3. Barbeta Terry, 909 Darren Drive, spoke in support of this item. <br />
