<br />Januarv 13. 2009 <br /> <br />At a Regular Meeting of the City Council on Tuesday, January, 13, 2009, there <br />were present: <br /> <br />Mayor James W. Holley III, Vice Mayor William E. Moody, Jr., Charles B. Whitehurst, <br />Sr., Marlene W. Randall, Stephen E. Heretick, Elizabeth M. Psi mas, Douglas L. Smith, <br />City Manager Kenneth L. Chandler, City Attorney G. Timothy Oksman. <br /> <br />Pastor Robert Lee opened the meeting with prayer, which was followed by the <br />Pledge of Allegiance to the Flag. <br /> <br />Mayor Holley called the meeting to order and welcomed all in attendance. <br /> <br />Mayor Holley recognized the Portsmouth Chapter of Delta Sigma Theta <br />Sorority Social Action Committee, Jems and Academy. <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Smith, to approve the minutes of a <br />Called Meeting of December 8, 2008, of a Called Meeting of December 9, 2008, of a <br />Regular Meeting of December 9, 2008, of a Called Meeting of December 16, 2008, of a <br />Special Meeting of December 16, 2008, and of a Called Meeting of January, 5, 2009 <br />,and was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />09 - 18 - Presentation: <br /> <br />. Presentation of special lapel pins to newly appointed Board and Commission <br />members. <br /> <br />- Public Hearing - <br /> <br />09 - 19 - Public hearing on use permits, code amendments, rezoning, and housing use <br />permit applications: <br /> <br />(a) UP-08-18 <br /> <br />DOWNTOWN - James Francis requests a use permit to operate a <br />gallery and cafe (restaurant) at 305 Columbia Street. The <br />Comprehensive Plan's Generalized Future Land Use Map <br />recommends Mixed Use Downtown Development. Vision Principle: <br />A Robust and Prospering Economy. <br /> <br />There were no speakers. <br /> <br />Motion by Mr. Heretick, and seconded by Mr. Moody, to concur with the <br />recommendation of the Planning Commission that UP-08-18 be approved on first <br />reading, and was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />(b) CA-08-08 <br /> <br />CITYWIDE - The City of Portsmouth requests code amendments to <br />Chapter 40 of the City Code concerning the dimensional <br />requirements for a Single Room Occupancy (SRO) facility. The <br />Comprehensive Plan recommends that the City provide housing to <br />serve persons of all socio-economic groups. Vision Principle: Bold <br />New Directions. <br /> <br />1. Mark Geduldig-Yatrofsky, 2713 Sterling Point Road, spoke in support of this item. <br /> <br />Motion by Mr. Smith, and seconded by Mr. Whitehurst, to concur with the <br />recommendation of the Planning Commission that CA-08-08 be approved on first <br />reading, and was adopted by the following vote: <br />
