<br />II <br /> <br />December 16. 2008 <br /> <br />355 <br /> <br />At a Called Meeting of the City Council on Tuesday, December 16, 2008, there were <br />present: <br /> <br />Mayor James W. Holley III, *Vice Mayor William E. Moody, Jr., Marlene W. Randall, Stephen E. <br />Heretick, Elizabeth M. Psimas, *Douglas L. Smith, Charles B. Whitehurst, Sr., City Manager <br />Kenneth L. Chandler, City Attorney G. Timothy Oksman. <br /> <br />08 - 542 - The following call for the meeting was read: <br /> <br />"Please attend a Called Meeting of the City Council to be held in the 6th Floor <br />Conference Room, 801 Crawford Street, 6:00 p.m., Tuesday, December 16, 2008 for the <br />purpose of a Closed Meeting. <br /> <br />By order of the Mayor." <br /> <br />08 - 543 - Motion by Mr. Heretick, and seconded by Ms. Randall, to go into Closed Meeting <br />pursuant to provisions of Section 2.2-3711 (A) of the Code of Virginia, to discuss appointments <br />to an advisory panel and to boards and commissions, as per subsection 1, and legal matters <br />requiring the advice of legal counsel, as per subsection 7. <br /> <br />The subject matter of the meeting is Council appointments, and also the pending <br />lawsuit over courthouse construction. <br /> <br />The purpose of the meeting is to allow confidential discussion of appointments and legal <br />strategy. <br /> <br />The motion was adopted by the following vote: <br /> <br />Ayes: Heretick, Psimas, Randall, Whitehurst, Holley <br />Nays: None <br /> <br />Motion by Mr. Moody, and seconded by Mr. Whitehurst, pursuant to Section 2.2-3712(D) <br />of the Code of Virginia, certifying that to the best of the Council Members' knowledge during the <br />immediately preceding Closed Meeting of the City Council: <br /> <br />1. Only public business matters lawfully exempted from open meeting requirements by <br />the Virginia Freedom of Information Act, and <br /> <br />2. Only such public business matters as were identified in the motion, by which <br />the Closed Meeting was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br /> <br />The motion was adopted by the following vote. <br /> <br />Ayes: Heretick, Moody, Psimas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />On motion, meeting adjourned. <br /> <br />Minutes prepared by: <br /> <br />~ <br /> <br />Anita Y.
