¸50 July 9, 1991 (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to ~ ~ insure compatibility with surrounding uses; (d) Will be a project t~at will be developed according to a plan for parking, driveways, and curb cu_ts-whic~ will provide for saf~ and convenient traffic movement; and (e) Will be in accordance with the purposes of the Zoning Chapter of the City Code. e That Susie ~.~Anthony is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, ~irgin-ia, 1988, to operate a child day~care services facility at 1220 Cavalier. Boulevard., said property being more particularly described as follows: Beginning on more or less right-of-way thence north right-of-way right-of-way UP-91-09 the west right-of-way of Cavalier Boulevard 170' north from its intersection with the north of Tazewell Street; thence west 150' to a point; 150' to a point; thence east 150' to the west of Cavalier Boulevard; thence south along said 150' to the point of beginning. 3. That the use permit is approved subject to the following conditions: (a) The facility shall be developed as shown on Exhibits A and B, attached hereto and made a part hereof. (b) Security lights shall be installed and maintained at the rear of the building - out of normal reach, and shall be operated with a dusk to dawn timer. (c) Panic bars shall be installed and maintained on the exit door.s. (d) No more than 42 children shall attend the facility. (e) The applicant must fully enclose the outdoor play area with a wood privacy fence at least six feet in height. (f) All outdoor operations shall be conducted between the hours of 8:00 a.m. and 8:30 p.m. (g) The faciIity shall be inspected annually by the City Fire Department, the City Health Department, and the City Fire Marshal. (h) The applicant shall comply with all applicable codes, ordinances, and regulations of federal, state and local governments and shall obtain all necessary licenses~and permits. (i) If the contract purchaser fails to obtain legal title to 1220 Cavalier Boulevard, Portsmouth, Virginia, this use permit shall become invalid and thereby revoked. (j) The-applicant-shall obtain approval from the City Engineer and/or Planning Director of a plan for the necessary parking, driveway, and curb cuts."
