Submission of the resolution will be followed by a request for approval by the <br />Commonwealth Transportation Board of Virginia and then approval by the Federal <br />Highway Administration. <br /> <br />1. Mark Geduldig-Yatrofsky, 2713 Sterling Point Drive, spoke in opposition to this item. <br /> <br />2. James Overton, 319 Astor Avenue, spoke in opposition to this item. <br /> <br />Motion by Mr. Smith, and seconded by Mr. Whitehurst, to adopt the following <br />resolution, and was adopted by the following vote: <br /> <br />"RESOLUTION OF THE COUNCIL OF THE CITY OF PORTSMOUTH, VIRGINIA <br />CONDITIONALLY APPROVING THE PROPOSED LOCATION OF THE ROUTE 58- <br />MARTIN LUTHER KING (MLK) FREEWAY EXTENSION PROJECT 0058-965-107, <br />P101 (UPC 77245) IN THE CITY OF PORTSMOUTH. <br /> <br />WHEREAS, a Location Public Hearing was conducted on May 14, 2008, in the <br />City of Portsmouth by representatives of the Commonwealth of Virginia, Department of <br />Transportation after due and proper notice for the purpose of considering the proposed <br />location of the Route 58 - Martin Luther King (MLK) Freeway Extension Project 0058- <br />965-107, P101 (UPC 77245) in the City of Portsmouth, at which hearing aerial <br />photographs, drawings and other pertinent information were made available for public <br />inspection in accordance with state and federal requirements; and <br /> <br />WHEREAS, all persons and parties in attendance were afforded full opportunity <br />to participate in said public hearing; and <br /> <br />WHEREAS, representatives of the City of Portsmouth were present and <br />participated in said hearing; and <br /> <br />WHEREAS, the Council had previously requested the Virginia Department of <br />Transportation to program this project; and <br /> <br />WHEREAS, the Council continues to desire this project, provided certain <br />legitimate citizen concerns are respected by the Virginia Department of Transportation. <br /> <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth <br />that it hereby approves the location of the proposed project as presented at the Public <br />Hearing; <br /> <br />BE IT FURTHER RESOLVED, that the Council of the City of Portsmouth looks <br />forward to its continued partnership with the Department of Transportation; <br /> <br />BE IT FURTHER RESOLVED, that as this project continues, the Council of the <br />City of Portsmouth looks forward to working with the Department of Transportation on <br />all aspects of the proposal, including but not limited to: the possible potential of tolls on <br />the roadway, the design of the roadway to facilitate the creation of a convenient, <br />attractive and harmonious community, ensuring that multi-modal forms of transportation <br />are available to Portsmouth residents in the future, and ensuring the needs of impacted <br />and relocated residents and businesses are met to the greatest extent possible. <br /> <br />BE IT FURTHER RESOLVED, that the support evidenced by this resolution is <br />conditioned on the Virginia Department of Transportation honoring the following <br />legitimate citizen concerns in a way satisfactory to the Council of the City of Portsmouth: <br />
