<br /> That the City Attorney be, and he hereby is, directed to
<br />institute eminent domain proceedings against the
<br />hereinafter-described property situate in the City of
<br />Portsmouth, Virginia, for the purpose of acquiring the fee
<br />simple title thereto pursuant to Sections 2.06, 2.07 and 2.08
<br />of the Charter of the City of Portsmouth, Virginia, as amended,
<br />and to deposit to the credit of %he Clerk of the Circuit Court
<br />of the City of Portsmouth, as provided by law, the sum
<br />hereinafter specified to compensate the owner of the property
<br />designated and shown as "Plat Showing Property To Be Acquired
<br />From James H~ Fi'nnegan For Right-of-way Purposes," made by
<br />Engineering Services, Inc., Civil Engineering~Land Surveying,
<br />dated January 15~ 1992, a copy of which plat is attached hereto
<br />and made ~part hereof.
<br />
<br />The name of the property owner is James H. Finnegan.
<br />
<br /> The amount to be deposi'ted to the credit of the Clerk of
<br />the Circuit Court of the City of Portsmouth is $55.00."

<br /> (I) Motion of Mr. King and seconded by Clemons the
<br />following resolution was adopted and by the following vote:
<br />
<br /> "A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN
<br /> PROPERTY OWNED BY A. C. BOATWRIGHT AND M. G. WHITEHURST
<br /> UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO THE CHARTER
<br /> OF THE CITY OF PORTSMOUTH, SAID PROPERTY BEING NECESSARY
<br /> FOR THE WIDENING IN THE HIG~ STREET PROJECT...
<br />
<br /> WHEREAS, the Council of the City of Portsmouth has
<br />determined it to be in the public interest to widen High Street
<br />in the High Street Project; and
<br />
<br /> WHEREAS~ the City has not been able to purchase the
<br />property described herein, necessary to the project, becausel
<br />owners thereof and the City have not been able to agree upon
<br />the price to be paid therefor; and
<br />
<br /> ~EREAS, the advancement of ~he work and the use of said
<br />property will be unreasonably delayed if said property is not
<br />made available for the project as soon as possible.
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City
<br />of Portsmouth, Virginia:

<br /> Boatwright & M. G. Whitehurst to be acquired by City of
<br /> Portsmouth, Virginia," made by Hassell & Folkes, P.C.,
<br /> Engineers, Surveyors & Planners, dated March 31, 1989, a copy
<br /> of which plat is attached hereto and made a part hereof.
