January 8. 2008 Motion by Mr. Moody, and seconded by Mr. R. Smith, to concur with the recommendation of the Planning Commission that UP-07 -28 be denied on first reading, and was adopted by the following vote: Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley Nays: None (c) POD-07-01 MIDTOWN - The City of Portsmouth seeks to create a parking overlay district at 2900 Turnpike Road (Former I. C. Norcom School Site and select properties in the general area) 1201, 1101, 1001, 901, 801, Frederick Boulevard, an unnumbered parcel on Frederick Boulevard, 703, 701 Airline Boulevard, 3115 Watson Street, 3116 and 3113 South Street, 1614 Hamilton Avenue and an unnumbered parcel on Hamilton Avenue. Vision Principle: Bold New Directions, Thriving Neighborhoods and a Sense of Community, and a Robust and Prospering Economy. There were no speakers. Motion by Ms. Psimas, and seconded by Mr. Heretick, to concur with the recommendation of the Planning Commission that POD-07 -01 be approved on first reading, and was adopted by the following vote: Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, Holley Nays: None - Unfinished Business - Consent Aqenda: 07 - 513 - Rezoning and use permit: Motion by Mr. Heretick, and seconded by Ms. Psi mas, to adopt the following ordinance and resolutions approved on first reading at the December 11, 2007 meeting, and was adopted by the following vote: 07-513 (a): "ZONING AMENDMENT ORDINANCE Z-07-15." 07-513 (b): "RESOLUTION GRANTING A USE PERMIT (UP-07-25) TO SAM D. MANDALERIS TO OPERATE AN EATING ESTABLISHMENT AT 433 HIGH STREET. WHEREAS, Sam D. Mandaleris has made application pursuant to Section 40- 43.1 of the Code of the City of Portsmouth, Virginia (2006) for the granting of a use permit for the operation of an eating establishment at 433 High Street, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of the application for a use permit with conditions.
