<br />January 22. 2008 <br /> <br />(c) Will be provided with sufficient landscaping to Insure compatibility with <br />surrounding uses; <br /> <br />(d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br />(e) Will be In accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That Verizon Wireless is hereby granted a use permit pursuant to Section <br />40-43.1 of the Code of the City of Portsmouth, Virginia (2006) to construct a cell phone <br />monopole and an access road and compound for the monopole at 5600 Greenbrook <br />Drive, Portsmouth, Virginia, and being more particularly described as: <br /> <br />UP-07-24 <br /> <br />Beginning at a property pin located at the northwest corner of the property on <br />Greenbrook Drive; thence, proceeding S 68007'26"E, 459.47 feet more or less to a <br />point; thence proceeding S 12011 '04"W 117.22 feet more or less to a point; thence <br />proceeding S 21011 '26"W 283.92 feet more or less to a point; thence proceeding N <br />6r35'44"W 486.21 feet more or less to a point; thence proceeding N 22023'46"E <br />394.98 feet more or less back to the point of beginning. The property is also known as <br />Tax Map 901, Parcel 1 and 5600 Greenbrook Drive. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) Prior to obtaining construction permits, a certified report from a qualified and <br />licensed professional engineer must be submitted to the Director of Planning <br />demonstrating that: <br /> <br />i. The proposed tower will meet the structural requirements of the statewide <br />building code and the requirements of, EIA-222E, Structural Standards for Steel <br />Antenna Towers and Antenna Supporting Structures; <br />ii. The non-ionizing electromagnetic radiation (NIER) that will be emitted <br />from the proposed facility, along with others on the same structure or in the immediate <br />vicinity, will not exceed exposure standards of the U.S. Government; and <br />iii. The tower will not cause interference with any equipment such as radio, <br />television and computers operated by users on adjacent properties. <br /> <br />(b) The applicant will submit a formal site plan. <br /> <br />(c) Existing vegetation will be preserved to the greatest extent possible during <br />construction. No clearing shall be done outside of the footprint of the site as shown in <br />the site plan dated September 5, 2007. <br /> <br />(d) The tower will be constructed to allow for co-location with two other carriers. In <br />addition, the owner of the subject property, Entercom Norfolk, LLC, or its successors in <br />interest and/or its assigns, agrees to reserve sufficient ground space on the site known <br />as 5600 Greenbrook Drive to accommodate the needs of future co-locators. <br /> <br />(e) Applicant agrees to maintain insurance with respect to its development and use <br />of the property for the proposed wireless communications tower. <br /> <br />(f) Lighting for the project will be directed in such a way as to not impact neighboring <br />residents' quality of life. <br />
