January 22. 2008 (c) Will be provided with sufficient landscaping to Insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be In accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Verizon Wireless is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (2006) to construct a cell phone monopole and an access road and compound for the monopole at 5600 Greenbrook Drive, Portsmouth, Virginia, and being more particularly described as: UP-07-24 Beginning at a property pin located at the northwest corner of the property on Greenbrook Drive; thence, proceeding S 68007'26"E, 459.47 feet more or less to a point; thence proceeding S 12011 '04"W 117.22 feet more or less to a point; thence proceeding S 21011 '26"W 283.92 feet more or less to a point; thence proceeding N 6r35'44"W 486.21 feet more or less to a point; thence proceeding N 22023'46"E 394.98 feet more or less back to the point of beginning. The property is also known as Tax Map 901, Parcel 1 and 5600 Greenbrook Drive. 3. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) Prior to obtaining construction permits, a certified report from a qualified and licensed professional engineer must be submitted to the Director of Planning demonstrating that: i. The proposed tower will meet the structural requirements of the statewide building code and the requirements of, EIA-222E, Structural Standards for Steel Antenna Towers and Antenna Supporting Structures; ii. The non-ionizing electromagnetic radiation (NIER) that will be emitted from the proposed facility, along with others on the same structure or in the immediate vicinity, will not exceed exposure standards of the U.S. Government; and iii. The tower will not cause interference with any equipment such as radio, television and computers operated by users on adjacent properties. (b) The applicant will submit a formal site plan. (c) Existing vegetation will be preserved to the greatest extent possible during construction. No clearing shall be done outside of the footprint of the site as shown in the site plan dated September 5, 2007. (d) The tower will be constructed to allow for co-location with two other carriers. In addition, the owner of the subject property, Entercom Norfolk, LLC, or its successors in interest and/or its assigns, agrees to reserve sufficient ground space on the site known as 5600 Greenbrook Drive to accommodate the needs of future co-locators. (e) Applicant agrees to maintain insurance with respect to its development and use of the property for the proposed wireless communications tower. (f) Lighting for the project will be directed in such a way as to not impact neighboring residents' quality of life.
