<br />December 11. 2007 <br /> <br />IT BEING that same property conveyed to Portsmouth Redevelopment and Housing <br />Authority by Deed of Bargain and Sale from Andrew J. Kalis, unmarried, and Rita K. <br />Parish (formerly Rita Kalis), unmarried, dated March 11, 1994, and recorded in the <br />Clerk's Office of the Circuit Court for the City of Portsmouth, Virginia, in Deed Book <br />1117 at Page 1063. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) The site layout plan and floor plan shall generally be in accordance with the site <br />layout plan and floor plan submitted July 18, 2007. <br /> <br />(b) The exterior of the duplex shall generally be in accordance with the elevations <br />submitted July 18, 2007. <br /> <br />(c) The applicant must meet all landscaping requirements in the City Code. <br /> <br />(d) Any and all changes to the submitted elevations shall be subject to the approval <br />of the Commission of Architectural Review I for Olde Towne, Cradock and Truxtun. <br /> <br />(e) The applicant shall utilize residential refuse collection as provided by the City of <br />Portsmouth. Garbage containers shall be kept at the rear of the property and hauled to <br />the front only on collection day for pick-up. <br /> <br />(f) The applicant shall obtain all required permits before commencing construction. <br /> <br />(g) Taxes and fees associated with the property shall be paid when due. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley <br />Nays: None <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Heretick, to adopt the following <br />resolution approved on first reading at the November 27, 2007 meeting, and was <br />adopted by the following vote: <br /> <br />07 -478 (h): <br /> <br />"RESOLUTION GRANTING A USE PERMIT (UP- 07-23) TO BRADLEY STEWART <br />TO OPERATE AN ENTERTAINMENT ESTABLISHMENT AT 702 AND 706 HIGH <br />STREET. <br /> <br />WHEREAS, Bradley Stewart has made application pursuant to Section 40-43.1 <br />of the Code of the City of Portsmouth, Virginia (2006) for the granting of a use permit to <br />operate an entertainment establishment at 702 and 706 High Street, Portsmouth, <br />Virginia; and <br /> <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br />WHEREAS, the Planning Commission has recommended the granting of the <br />application for a use permit with conditions. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1.
