December 11. 2007 IT BEING that same property conveyed to Portsmouth Redevelopment and Housing Authority by Deed of Bargain and Sale from Andrew J. Kalis, unmarried, and Rita K. Parish (formerly Rita Kalis), unmarried, dated March 11, 1994, and recorded in the Clerk's Office of the Circuit Court for the City of Portsmouth, Virginia, in Deed Book 1117 at Page 1063. 3. That the use permit is approved subject to the following conditions which shall be observed by the applicant and any successor in interest: (a) The site layout plan and floor plan shall generally be in accordance with the site layout plan and floor plan submitted July 18, 2007. (b) The exterior of the duplex shall generally be in accordance with the elevations submitted July 18, 2007. (c) The applicant must meet all landscaping requirements in the City Code. (d) Any and all changes to the submitted elevations shall be subject to the approval of the Commission of Architectural Review I for Olde Towne, Cradock and Truxtun. (e) The applicant shall utilize residential refuse collection as provided by the City of Portsmouth. Garbage containers shall be kept at the rear of the property and hauled to the front only on collection day for pick-up. (f) The applicant shall obtain all required permits before commencing construction. (g) Taxes and fees associated with the property shall be paid when due. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley Nays: None Motion by Ms. Psi mas, and seconded by Mr. Heretick, to adopt the following resolution approved on first reading at the November 27, 2007 meeting, and was adopted by the following vote: 07 -478 (h): "RESOLUTION GRANTING A USE PERMIT (UP- 07-23) TO BRADLEY STEWART TO OPERATE AN ENTERTAINMENT ESTABLISHMENT AT 702 AND 706 HIGH STREET. WHEREAS, Bradley Stewart has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (2006) for the granting of a use permit to operate an entertainment establishment at 702 and 706 High Street, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of the application for a use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That it finds that the use for which the permit is sought:
