<br />December 11. 2007 <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That it finds that the use for which the permit is sought: <br /> <br />(a) Will not adversely affect the health and safety of persons residing or working in <br />the neighborhood of the proposed use; <br /> <br />(b) Will not be detrimental to the public use or InJurious to the property or <br />improvements in the neighborhood; <br /> <br />(c) Will be provided with sufficient landscaping to Insure compatibility with <br />surrounding uses; <br /> <br />(d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br />(e) Will be In accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That Sara Steele is hereby granted a use permit pursuant to Section 40- <br />43.1 of the Code of the City of Portsmouth, Virginia (2006) to construct a duplex at 605 <br />and 607 London Street, Portsmouth, Virginia, and being more particularly described as: <br /> <br />UP-07-20 <br /> <br />605 London Street <br /> <br />ALL THAT certain lot, piece or parcel of land, with the buildings and improvements <br />thereon and the appurtenances thereunto belonging, lying, situate, and being in the City <br />of Portsmouth, Virginia and being more particularly bounded and described as follows: <br /> <br />Beginning at a point on the south side of London Boulevard (formerly London Street) 60 <br />feet west from the southwest intersection of London Boulevard and Washington Street, <br />thence east along London Boulevard 25 feet to the center of a 3 foot alley, thence south <br />along the center of said alley 85 feet, thence west 25 feet; and thence north 85 feet to <br />the point of beginning, said 3 foot alley to be used in common by the owner of this <br />property and the owners of the eastern one-half of said alley. <br /> <br />IT BEING that same property conveyed to Portsmouth Redevelopment and Housing <br />Authority by Deed of Bargain and Sale from Robert Frederick Casey, unmarried, and <br />Richard D. LeDonne, unmarried, dated December 23, 1997, and recorded in the Clerk's <br />Office of the Circuit Court for the City of Portsmouth, Virginia in Deed Book 1215 at <br />Page 27. <br /> <br />607 London Street <br /> <br />ALL THAT certain lot, piece or parcel of land, with the buildings and improvements <br />thereon and the appurtenances thereunto belonging, lying, situate, and being in the City <br />of Portsmouth, Virginia and being more particularly bounded and described as follows: <br /> <br />Beginning on the south side of London Street (now known as London Boulevard) Sixty <br />(60) feet West of Washington Street; thence running West on London Street Thirty (30) <br />feet; thence South and parallel to Washington Street Eighty-eight (88) feet; thence East <br />and parallel with London Street Thirty (30) feet; thence North and parallel with <br />Washington Street Eighty-eight (88) feet to the point of the beginning. <br />
