:396 <br /> <br />June 23, 1992 <br /> <br />(d) Will be a project that will be developed according to a <br />plan for parking, driveways, and curb cuts which will provide <br />for safe and convenient traffic movement; and <br /> <br />(e) Will be in accordance with the purposes of the City of <br />Portsmouth Zoning Ordinance. <br /> <br /> 2. That Discipleship Baptist Church is hereby granted a <br />use permit pursuant to Section 40-43.1 of the Code of the City <br />of Portsmouth, Virginia, 1988, for the operation of a church on <br />property located at 3600 Race Street and being more <br />particularly described as: <br /> <br />UP-92-11 <br /> <br />Beginning at the northwest intersection of Race <br />Street and Halifax Avenue; thence west along the <br />north right-of-way of Race Street 120' to a point; <br />thence north 108.5' to a point; thence east 120' to <br />the west right-of-way of Halifax Avenue; thence south <br />along said right-of-way 108.5' to Race Street, the <br />point of beginning. <br /> <br /> 3. That this use permit is approved subject to the <br />following conditions: <br /> <br />(a) Parking shall be provided in accordance with the approved <br />site layout plan (Exhibit A), attached hereto and made a part <br />hereof. <br /> <br />(b) If the subject property at any time becomes non-taxable, <br />this use permit shall expire." <br /> <br />Ayes: Clemons, Corprew, Epperson, Hawks, King, Williams, Webb <br />Nays: None <br /> <br />CITY MANAGER'S REPORT <br /> <br />92-203 Letter from the City Manager recommending adoption of <br />an ordinance to amend Chapter 23 of the code of the City of <br />Portsmouth, Virginia, 1988, by amending Sections 23-4, 23-27 <br />(a) and (b), 23-30, 23-48 (a) and (b), and 23-50 (b) thereof, <br />pertaining to nuisances. <br /> <br /> "The 1992 General Assembly of Virginia enacted several <br />laws pertaining to nuisances that are enforced by our <br />Environmental Services department. Since these requirements do <br />not coincide with the requirements presently listed in our City <br />Code, an ordinance change is necessary to comply with this new <br />State law. The proposed ordinance will change regulations <br />dealing with weeds, debris and inoperative motor vehicles. <br /> <br /> I respectfully request and recommend your approval of <br />this ordinance." <br /> <br /> Motion of Mr. King, seconded by Mr. Epperson, the <br />following ordinance was adopted on first and final reading and <br />by the following vote: <br /> <br /> "AN ORDINANCE TO AMEND CHAPTER 23 OF THE CODE OF THE <br />CITY OF PORTSMOUTH, VIRGINIAt 1988, BY AMENDING SECTIONS 23-4, <br />23-27(A) AND (B), 23-30, 23-48(A) AND (B), AND 23-50(B) <br />THEREOF, PERTAINING TO NUISANCES.,' <br /> <br />Ayes: Clemons, Corprew, Epperson, Hawks, King, Williams, Webb <br />Nays: None <br /> <br /> <br />
