:396 June 23, 1992 (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Discipleship Baptist Church is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia, 1988, for the operation of a church on property located at 3600 Race Street and being more particularly described as: UP-92-11 Beginning at the northwest intersection of Race Street and Halifax Avenue; thence west along the north right-of-way of Race Street 120' to a point; thence north 108.5' to a point; thence east 120' to the west right-of-way of Halifax Avenue; thence south along said right-of-way 108.5' to Race Street, the point of beginning. 3. That this use permit is approved subject to the following conditions: (a) Parking shall be provided in accordance with the approved site layout plan (Exhibit A), attached hereto and made a part hereof. (b) If the subject property at any time becomes non-taxable, this use permit shall expire." Ayes: Clemons, Corprew, Epperson, Hawks, King, Williams, Webb Nays: None CITY MANAGER'S REPORT 92-203 Letter from the City Manager recommending adoption of an ordinance to amend Chapter 23 of the code of the City of Portsmouth, Virginia, 1988, by amending Sections 23-4, 23-27 (a) and (b), 23-30, 23-48 (a) and (b), and 23-50 (b) thereof, pertaining to nuisances. "The 1992 General Assembly of Virginia enacted several laws pertaining to nuisances that are enforced by our Environmental Services department. Since these requirements do not coincide with the requirements presently listed in our City Code, an ordinance change is necessary to comply with this new State law. The proposed ordinance will change regulations dealing with weeds, debris and inoperative motor vehicles. I respectfully request and recommend your approval of this ordinance." Motion of Mr. King, seconded by Mr. Epperson, the following ordinance was adopted on first and final reading and by the following vote: "AN ORDINANCE TO AMEND CHAPTER 23 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIAt 1988, BY AMENDING SECTIONS 23-4, 23-27(A) AND (B), 23-30, 23-48(A) AND (B), AND 23-50(B) THEREOF, PERTAINING TO NUISANCES.,' Ayes: Clemons, Corprew, Epperson, Hawks, King, Williams, Webb Nays: None
