<br />September 25. 2007 <br /> <br />(c) Will be provided with sufficient landscaping to Insure compatibility with <br />surrounding uses; <br /> <br />(d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br />(e) Will be In accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That Sarah Grant is hereby granted a use permit pursuant to Section 40- <br />43.1 of the Code of the City of Portsmouth, Virginia (2006) to operate a nursing and <br />personal care facility at 1535 Marshall Avenue, Portsmouth, Virginia, and being more <br />particularly described as: <br /> <br />UP-07-09 <br /> <br />All that certain lot, piece or parcel of land, with the buildings and improvements thereon, <br />situate, lying and being in the City of Portsmouth, Virginia, and bounded and described <br />as follows: Beginning 325 feet West of the Southwest corner of the intersection of <br />Marshall Avenue and Beech Street; thence South 01 degrees 22'43" West a distance of <br />187.84 feet to a point; thence North 40 degrees 052'10" West a distance of 74.37 feet to <br />a point; thence North 01 degrees 22'43" East a distance of 132.79 feet to a point; <br />thence South 88 degrees 37'17" East a distance of 50.00 feet along the southern side of <br />Marshall Avenue to the point of beginning. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />shall be observed by the applicant and any successor in interest: <br /> <br />(a) There shall be no more than eight persons needing care residing at the location <br />at any given time. <br /> <br />(b) The applicant shall provide an 18-foot by 18-foot concrete pad on the property for <br />two (2) parking spaces. The pad shall not interfere with the planned handicapped ramp. <br /> <br />(c) The applicant shall provide a six-foot fence along the rear property line. The <br />fence shall be made of a solid material (i.e. vinyl or wood). No chain link fence shall be <br />permitted. <br /> <br />(d) The facility shall be operated and maintained in accordance with all required <br />inspections by the City Fire Department, Public Health Department, and Building Official <br />and shall include annual inspections. <br /> <br />(e) The facility shall be operated in compliance with all applicable codes, ordinances, <br />and regulations of federal, state, and local governments, and all required licenses and <br />permits shall be obtained and remain in effect during the operation of the facility. <br /> <br />(f) Taxes and fees associated with the property shall be paid when due. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />07-387 (b): <br />"ZONING AMENDMENT ORDINANCE Z-07-11." <br /> <br />07 -387 (c): <br />"ZONING AMENDMENT ORDINANCE Z-07-12." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, D.
