July 14, 1992 437 "The Fiire Chief is reqUeSting the Code of the City of Portsmouth bie amended by adding in the Fire Protection and Prevention Chapter, House Bill 628, authorizing the local Fire Marshal the ~_lght to investigate releases of hazardous materials, hazardous waste, or regulated substances. House Bill 628 has been approved by the General Assembly and grants local jurisdictions the authorit to authorize these duties. With th s adOption, the Fire Marshal will be authorized to enter upon any property from which a release of any hazardous material, hazardous waste, or regulated substances is suspected in order to investigate the extent and cause of any such releases. Additioaally, the Chief is requesting the Code be amended to adopt the National Fire Protection Association (NFPA) Codes and all amendments to be used as a reference and standard to Portsmouth's existing Fire Code. The NFPA codes will provide guidance in any areas of concern ~hat are not addressed by the Virginia Sta~ewide Fire Prevention Code. This inclusion will also provide an i~creased level of safeguards to life and property from the hazards )f fire or explosion. I, therefore, recommend your approval of the attached ordinance." Motion )f Mr. Clemons, seconded by Mr. Epperson, the following ordinance was adopted on first and final reading and by the followin vote: "AN ORD NANCE TO AMEND CHAPTER 13 OF THE CODE OF THE CITY OF PORTSMOUTH, ~IRGINIA, 1988, BY ADDING SECTION 13-61 THERETO, AND BY AMENDING ~ECTION 13-82 THEREOF, PERTAINING TO FIRE PROTECTION AND PREVENTI)N." Ayes: ClemOls, Epperson, Griffin, Hawks, King, Pitts, Webb Nays: None 92-238 - Let ;er from the City Manager recommending adoption of two amended resolutions to acquire portions of properties by Eminent Domain. "The Director of Public Utilities and the City Attorney have advised me tilat they and their independent legal counsel need to amend the re~Olutions previously obtained for two parcels required to build the new water transmission main. This amendment would allow for us~ of eminent domain to obtain both temporary and permanent ea:~ements across the two parcels. Your previous action only provide~ for temporary easements across these parcels. t also ?oncur with this recommendation and hereby request your approval, of the attached resolutions to prOceed with the condemnation of two parcels of land along the route proposed for the new wate~ transmission main," Motion ~f Mr. Clemons, seconded by Mr. King, the following resolution following vol (A) "A RESO] AND TEMPORARi THOMAS W.
