July 14, 1992 <br /> <br />437 <br /> <br /> "The Fiire Chief is reqUeSting the Code of the City of <br />Portsmouth bie amended by adding in the Fire Protection and <br />Prevention Chapter, House Bill 628, authorizing the local Fire <br />Marshal the ~_lght to investigate releases of hazardous materials, <br />hazardous waste, or regulated substances. House Bill 628 has been <br />approved by the General Assembly and grants local jurisdictions <br />the authorit to authorize these duties. <br /> <br /> With th s adOption, the Fire Marshal will be authorized to <br />enter upon any property from which a release of any hazardous <br />material, hazardous waste, or regulated substances is suspected in <br />order to investigate the extent and cause of any such releases. <br /> <br /> Additioaally, the Chief is requesting the Code be amended to <br />adopt the National Fire Protection Association (NFPA) Codes and <br />all amendments to be used as a reference and standard to <br />Portsmouth's existing Fire Code. The NFPA codes will provide <br />guidance in any areas of concern ~hat are not addressed by the <br />Virginia Sta~ewide Fire Prevention Code. This inclusion will also <br />provide an i~creased level of safeguards to life and property from <br />the hazards )f fire or explosion. <br /> <br /> I, therefore, recommend your approval of the attached <br />ordinance." <br /> <br /> Motion )f Mr. Clemons, seconded by Mr. Epperson, the <br />following ordinance was adopted on first and final reading and by <br />the followin vote: <br /> <br /> "AN ORD NANCE TO AMEND CHAPTER 13 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, ~IRGINIA, 1988, BY ADDING SECTION 13-61 THERETO, AND <br />BY AMENDING ~ECTION 13-82 THEREOF, PERTAINING TO FIRE PROTECTION <br />AND PREVENTI)N." <br /> <br />Ayes: ClemOls, Epperson, Griffin, Hawks, King, Pitts, Webb <br />Nays: None <br /> <br />92-238 - Let ;er from the City Manager recommending adoption of two <br />amended resolutions to acquire portions of properties by Eminent <br />Domain. <br /> <br /> "The Director of Public Utilities and the City Attorney have <br />advised me tilat they and their independent legal counsel need to <br />amend the re~Olutions previously obtained for two parcels required <br />to build the new water transmission main. This amendment would <br />allow for us~ of eminent domain to obtain both temporary and <br />permanent ea:~ements across the two parcels.
