<br />July 24. 2007 <br /> <br />Motion by Mr. R. Smith, and seconded by Mr. D. Smith, to adopt the following <br />ordinance approved on first reading at the July 10, 2007 meeting, and was adopted by <br />the following vote: <br /> <br />07-312 (d): <br />"ZONING AMENDMENT ORDINANCE Z-07-09." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley <br />Nays: None <br /> <br />Motion by Mr. R. Smith, and seconded by Ms. Psimas, to adopt the following <br />resolution approved on first reading at the July 10, 2007 meeting, and was adopted by <br />the following vote: <br /> <br />1. Clifford Kalmbach, 3702 Magnolia Drive, spoke in opposition to this item. <br /> <br />07-312 (e): <br /> <br />"RESOLUTION GRANTING APPROVAL OF A HOUSING USE PERMIT (HP-07-05) <br />TO CHURCHLAND COMMONS, LLC, TO CONSTRUCT 15 RESIDENTIAL <br />CONDOMINIUM TOWNHOUSE UNITS AT TOWNE POINT ROAD AND TWIN PINES <br />ROAD. <br /> <br />WHEREAS, Churchland Commons, LLC, pursuant to Section 40-112 of the <br />Code of the City of Portsmouth, Virginia (2006), as amended, has made application for <br />the granting of a housing use permit (HP-07 -05) to construct 15 residential <br />condominium townhouse units at Towne Point Road and Twin Pines Road, Portsmouth, <br />Virginia; and <br /> <br />WHEREAS, the subject property is furthermore described as: <br /> <br />HP-07-05 <br /> <br />Beginning one hundred eighty-five (185) feet east from the northwest intersection of <br />Towne Point Road and Twin Pines Road; thence in a westerly direction 353.83':t to a <br />point; thence, in a northerly direction 145.71':t to a point; thence in an easterly direction <br />337.83':t to a point; thence in a southerly direction 146.57':t to a point of the beginning. <br /> <br />and <br /> <br />WHEREAS, the Planning Commission has reviewed the submitted application <br />and site plan and has recommended conditional approval of said application; and <br /> <br />WHEREAS, the applicant has been informed that approval of the housing permit <br />pursuant to Section 40-116 only grants an exemption from certain requirements for <br />residences as stated in said section and does not constitute a waiver of any other <br />requirement embodied in the City Subdivision Ordinance, the City Zoning Ordinance, or <br />any other applicable local, state or federal law or regulation; and <br /> <br />WHEREAS, the applicant is aware that building permits and any other required <br />permit will be issued only upon compliance with the ordinances, laws or regulations <br />applicable thereto. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br />1. That, coupled with the terms imposed by paragraph 2 hereof, the following <br />conditions exist: <br />
