<br />July 24. 2007 <br /> <br />(b) Will not be detrimental to the public use or InJurious to the property or <br />improvements in the neighborhood; <br /> <br />(c) Will be provided with sufficient landscaping to Insure compatibility with <br />surrounding uses; <br /> <br />(d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br />(e) Will be In accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That Old Town Hospitality, L.L.C., is hereby granted a use permit pursuant <br />to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (2006) for a hotel at <br />Seventh Street and the Crawford Connector in the PortCentre Commerce section, and <br />being more particularly described as: <br /> <br />UP-07-14 <br /> <br />That parcel described as beginning at a property pin located at the northwest corner of <br />the property at the corner of Seventh Street and the Crawford Connector. Thence, <br />proceeding along the northern boundary of the property until reaching Port Centre <br />Parkway, thence, proceeding S 03023'29"E 82.83 feet more or less to a point thence, <br />proceeding along the southern boundary of the property along the property line now or <br />formerly belonging to the Seaboard Coastline Railroad until reaching the closed section <br />of Fifth Street, thence proceeding S 04007'16"E 20.69 feet more or less to a point, <br />thence again proceeding along the southern boundary of the property along the <br />property line now or formerly belonging to the Seaboard Coastline Railroad until <br />reaching Seventh Street, thence proceeding N 03029'27"W 217.70 feet more or less to <br />a point, more or less to a point of beginning. Property is also known as Tax Parcel <br />Number 0017-0010 and Tax Parcel Number 0017-0020 and a closed portion of Fifth <br />Street. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />the applicant and any successor in interest shall observe: <br /> <br />(a) The establishment shall be operated in compliance with all applicable codes, <br />ordinances, and regulations of federal, state, and local governments. <br /> <br />(b) The applicant shall obtain all required licenses and permits before operation and <br />these licenses and permits shall remain in effect during the operation of the <br />establ ishment. <br /> <br />(c) The applicant shall obtain a Subdivision Permit from the City before construction <br />can begin. <br /> <br />(d) The applicant shall construct the development in accordance with the submitted <br />plans dated April 10, 2007 and submitted elevations submitted May 15, 2007. The <br />Director of Planning and Zoning may approve minor modifications. The establishment <br />shall be operated in compliance with all applicable codes, ordinances, and regulations <br />of federal, state, and local governments. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, D.
