August ll, 1992 <br /> <br /> I, therefore, concur with this recommendation and request <br />your approval of the code amendment." <br /> <br /> Motion of Mr. Griffin and seconded by Mr. Hawks the <br />following ordinance was adopted on first and final reading and <br />by the following vote: <br /> <br />"AN ORDINANCE TO AMEND CHAPTER 25 OF THE CODE OF THE CITY <br />OF PORTSMOUTH, VIRGINIA, 1988, BH AMENDING ARTICLE VIII, <br />SECTIONS 25-226, 25-227, AND 25-228 THERETO PERTAINING <br />TO PARKS AND RECREATION." <br /> <br />Ayes: Clemons, Epperson, Griffin, Hawks, King, Pitts, Webb <br />Nays: None <br /> <br /> 92-271 - Letter from the City Manager recommending <br />adoption of an ordinance to amend Chapter 22 of the code of the <br />City of Portsmouth, Virginia, 1988, by amending Section 22-423 <br />thereof, pertaining to motor vehicles and traffic. <br /> <br /> "~he 1992 General Assembly made minor revisions to and <br />renumbered the provisions of Section 18.2-268 of the Code of <br />Virginia pertaining to the testing of motor vehicle operators <br />for drug and alcohol blood content. The City Attorney's Office <br />has drafted and recommends adoption of the amendment to Section <br />22-423 of the City Code which will make City Code references <br />consistent with the new state code numbering. ~ <br /> <br /> I concur with this recommendation that the amended <br />ordinance be adopted." <br /> <br /> Motion of Mr. King and seconded bY Mr. Hawks, !the <br />following ordinance was adopted on first and final reading, and <br />by the following vote: <br /> <br /> "AN ORDINANCE TO AMEND CHAPTER 22 OF THE CODE OF THE CITY <br /> OF PORTSMOUTH, VIRGINIA, 1988, BY AMENDING SECTION 22-423 <br /> THEREOF, PERTAINING TO MOTOR VEHICLES AND TRAFFIC." <br /> <br />Ayes: Clemons, Epperson, Griffin, Hawks, King, Pitts, Webb <br />Nays: None <br /> <br /> 92-272 - Letter from the City Manager recommending <br />adoption of a resolution granting an easement to Virginia Power <br />adjacent to ~he Edinburgh Square garage for placement of a <br />transfOrmer. <br /> <br /> "Approximately a year ago, Virginia Power removed a <br />transformer used for the downtown area from the Leggett <br />Building. Virginia Power determined that such a placement was <br />no longer advisable for them or the building owner. T~e <br />transformer was then placed on City property adjacent to the <br />Edinburgh Square parking garage. During this time~ Virginia <br />Power omitted obtaining an easement for the new~ placement. <br /> <br /> The City Attorney has reviewed the proposed easement with <br />the City Engineer, and has ins~rte~ a clause providing that the <br />City may require the transformer's removal to another area <br />should the City should find it necessary. <br /> <br /> I believe the execution of such an easement is in the <br />interest of the City, and recommend your adoption of this <br />resolution." <br /> <br />best <br /> <br /> Motion of Mr. Epperson and seconded by Mr. Clemons, <br />the following resolution was adopted, and by the following <br />vote: <br /> <br /> <br />
