<br />June 26. 2007 <br /> <br />(f) Noise may not be audible to adjacent residents or businesses, or at any adjacent <br />or surrounding property lines. <br /> <br />(g) The applicant shall utilize commercial garbage collection that employs an inside <br />container, which has been approved by General Services. <br /> <br />(h) The establishment shall be operated in compliance with all applicable codes, <br />ordinances, and regulations of federal, state, and local governments. <br /> <br />(i) The applicant shall obtain all required licenses and permits before operation and <br />these licenses and permits shall remain in effect during the operation of the <br />establ ishment. <br /> <br />(j) Taxes and fees associated with the property shall be paid when due. <br /> <br />(k) The owners and/or operators of the restaurant shall not violate any laws of the <br />Commonwealth or ordinances of the City related to peace and good order, nor suffer <br />repeated or chronic violations by any of its patrons or customers. <br /> <br />If the Chief of Police, in his discretion, determines that there are sufficient violations of <br />this type to comprise a significant law enforcement problem, he shall so notify the <br />applicant in writing and shall provide a copy of such notice to the Director of Planning <br />and Zoning. <br /> <br />If, within six (6) months of the date of such letter, the Director of Planning and Zoning <br />determines that the offenses against peace and good order are continuing, then he may <br />initiate proceedings for the revocation of this permit. Provided, however, that if such <br />problems are of severity that the Chief of Police determines that there is a significant <br />risk to public safety or peace and good order of such proportions as to create a risk of <br />blight, the revocation proceedings may be initiated by the Director of Planning and <br />Zoning regardless of the six (6) month requirement which is otherwise applicable. <br /> <br />4. Smith, Holley <br />Nays: None <br /> <br />- City Manager's Report - <br /> <br />07 - 281 - Adoption of an ordinance appropriating in the FY 2006-2007 Grants Fund a <br />grant in the amount of $850,538.95 received by the Department of Parks, Recreation, <br />and Leisure Services from the United States Department of Agriculture. Vision <br />Principle: Thriving Neighborhoods and a Sense of Community. <br /> <br />Background: <br />. The City of Portsmouth has received a grant from USDA for the Summer Food <br />Program for more than 25 years, administered by the Recreation Division. <br />. Each year the program has grown to accommodate more churches, civic <br />organizations, schools and recreation locations. <br />. The program provides meals during the summer months when children are out of <br />school and the free and reduced school lunch program is not available. <br /> <br />Discussion: <br />. The USDA Summer Food Program for 2007 will include 39 sites consisting of <br />Summer School sites; faith based childcare programs, community organizations and <br />City of Portsmouth Recreation sites. <br />. It is estimated that the program will serve 4,345 breakfasts and 5,920 lunches <br />per day during the summer months. <br />
