" <br /> <br /> Motion of Mr. Griffin and seconded by Mr. King, the following <br />resolution was adopted and by the following vote: <br /> <br /> "A RESOLUTION ESTABLISHING AN AMERICANS WITH DISABILITIES <br />COMMISSION. <br /> <br /> WHEREASi the Americans With Disabilities Act was signed into <br />law by the P~esident of the Unfte~.States in 1990; and <br /> <br /> WHEREAS; this federal legislation was enacted to ensure that <br />individuals ~ith disabilities receive equal employment <br />opportunities and other services on an equal basis a's that of <br />non-disabled persons; and <br /> <br /> WHEREAS <br />employ fifty <br />procedure ~0] <br />to discrimin~ <br />and <br /> <br /> WHEREAS <br />employ more <br /> <br /> this legislation requires public entities that <br /> (50) or more persons to establish a grievance <br />· resolution of complaints from the public pertaining <br />~tion on the basis of disability by a public entity; <br /> <br />the City of pOrtsmouth is a public entity and does <br />han fifty (50) persons. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED'that the Council of the City <br />of Portsmouth, Virginia, hereby establishes an Americans with <br />Disabilities~Commission consisting of seven members who shall be <br />appointed for three year terms; provided however, that of those <br />persons firs~ appointed, three (3) shall be appointed for three <br />(3) years, t~o (2) shall be appointed for two (2) years, and two <br />(2) shall be appointed for one (1) year. Additionally, the <br />membership s~all be represented as follows: one member each shall <br />be from the usiness community, the medical community, and the <br />educational ommunity; one member shall be a representative from a <br />non~uprofit c ganization; two'members shall be disabled ~ <br />individuals; and one member shall be either~a resident; property <br />or business cwner within the City or shall be employed in the <br />City. The City's ADA Coordinator shall be the liaison to this <br />Commission ard shall attend the meetings of the Commission. <br /> <br /> BE IT FI RTHER RESOLVED that this Council may remove any <br />member of th s Commission for inefficiency, neglect of duty, <br />misfeasance, or malfeasance in office. Any vacancy in the <br />membership of this Commission shall be filled by the City Council <br />for the unex] ired portion of"the~term. <br /> <br /> BE IT F~ <br /> RTHER RESOLVED that the Americans with Disabilities <br />Commission s]all have as its functions the following <br />responsibilil les: <br /> <br />1. To understand and comply with the Americans with Disabilities <br />Act of 1990. <br /> <br />2. To estaklish ground rules for procedures for hearing appeals <br />from determinations of the City's EEO Coordinator, requests or <br />suggestions from or on behalf of disabled persons regarding access <br />to and the participation in public facilities, services, <br />activities an~ functions in the community and any other reasonable <br />rules for the conduct of its business. <br />3.
