Motion of Mr. Hawks and seconded by Mr. King, the following resolution was adopted and by the following vote: "A RESOLUTION AUTHORIZING THE VIRGINIA DEPARTMENT ~OF TRANSPCRTATION TO.PROCEED WITH THE PROJECT FOR IMPROVEMENTS TO CHURCHLAND BOULEVARD IN T~E CITY OF PORTSMOUTH, VIRGINIA. WHEREAS~ a Location and Design Public Hearing was conducted on May 13, 1992, in the City of Portsmouth by representatives of the Commonwealth of Virginia, Department of Transportation after due and proper notice for the purpose of considering the proposed location and design of Churchland Boulevard, Projects: U000-124-105, C501 and U000-131-113, C501 in the Cities of Chesapeake and Pcrtsmouth, at which hearing aerial photographs, drawings and other pertinent information were made available for public inspection in accordance with state and~federal requirements; and WHEREAS, all persons and parties in.attendance were afforded full opportunity to participate in said public hearing; and WHEREAS, representatives of the Cities of Chesapeake and Portsmouth~were present and participated in said hearing; and WHEREAS, the Council has previously requested the Virginia Department of Transportation to program this project; and WHEREAS, the Council considered all such matters. NOW, THEREFORE, BE IT RESOLVED that the Council~ o~ t~e City of Portsmouth hereby approves the location and major design features of the proposed project but. only if the project includes sidewalks, five feet in width on both sides of the project and for the entire length of the project and, as presented at the Public Hearing; and BE IT FURTHER RESOLVED that the City of Portsmouth requests the Virginia Department of Transportation to acquire all rights of way necessary for this project conveying said rights of way to the City at the appropriate time; and that the City Manager be and he hereby is authorized to execute, on behalf of the City of Portsmouth, all necessary railroad and utility agreements required in conjunction with acquiring such rights of way." Ayes: Griffin, Hawks, King, Pitts, Webb ~ Nays: Epperson ~ 92-329 - Letter from the City Manager recommending adoption of a resolution establishing an Americans with Disabilities Commission ~for the City of Portsmouth, Virginia. "As previously discussed, many provisions of the Americans with Disabilities Act of 1990 went into effect this year. This Act requires employers with 50 or more employees to establish grievance procedures ~o review and.resolve complaints that~ arise under this Act. ' The attached resolution establishes an Americans with Disabilities Commission to review and resolve complaints from citizens which may arise under the Act. The seven member Commission should decrease the number of complaints which will be filed with the Equal Employment Opportunity Commission and the Justice Department.
