September 22, 1992. <br /> <br /> I concur with the Director of~ Public Works and recommend <br />your adoption of the resolution as presented." <br /> <br /> Motion of Mr. Hawks and seconded by Mr. King, the <br />following resolution was adopted and by the following vote: <br /> <br /> "A RESOLUTION AUTHORIZING THE VIRGINIA DEPARTMENT ~OF <br />TRANSPCRTATION TO.PROCEED WITH THE PROJECT FOR IMPROVEMENTS TO <br />CHURCHLAND BOULEVARD IN T~E CITY OF PORTSMOUTH, VIRGINIA. <br /> <br /> WHEREAS~ a Location and Design Public Hearing was <br />conducted on May 13, 1992, in the City of Portsmouth by <br />representatives of the Commonwealth of Virginia, Department of <br />Transportation after due and proper notice for the purpose of <br />considering the proposed location and design of Churchland <br />Boulevard, Projects: U000-124-105, C501 and U000-131-113, C501 <br />in the Cities of Chesapeake and Pcrtsmouth, at which hearing <br />aerial photographs, drawings and other pertinent information <br />were made available for public inspection in accordance with <br />state and~federal requirements; and <br /> <br /> WHEREAS, all persons and parties in.attendance were <br />afforded full opportunity to participate in said public <br />hearing; and <br /> <br /> WHEREAS, representatives of the Cities of Chesapeake and <br />Portsmouth~were present and participated in said hearing; and <br /> <br /> WHEREAS, the Council has previously requested the Virginia <br />Department of Transportation to program this project; and <br /> <br /> WHEREAS, the Council considered all such matters. <br /> NOW, THEREFORE, BE IT RESOLVED that the Council~ o~ t~e <br />City of Portsmouth hereby approves the location and major <br />design features of the proposed project but. only if the project <br />includes sidewalks, five feet in width on both sides of the <br />project and for the entire length of the project and, as <br />presented at the Public Hearing; and <br /> <br /> BE IT FURTHER RESOLVED that the City of Portsmouth <br /> requests the Virginia Department of Transportation to acquire <br /> all rights of way necessary for this project conveying said <br /> rights of way to the City at the appropriate time; and that the <br /> City Manager be and he hereby is authorized to execute, on <br /> behalf of the City of Portsmouth, all necessary railroad and <br /> utility agreements required in conjunction with acquiring such <br /> rights of way." <br /> <br /> Ayes: Griffin, Hawks, King, Pitts, Webb ~ <br /> Nays: Epperson ~ <br /> <br /> 92-329 - Letter from the City Manager recommending adoption of <br /> a resolution establishing an Americans with Disabilities <br /> Commission ~for the City of Portsmouth, Virginia. <br /> <br /> "As previously discussed, many provisions of the Americans <br /> with Disabilities Act of 1990 went into effect this year. This <br /> Act requires employers with 50 or more employees to establish <br /> grievance procedures ~o review and.resolve complaints that~ <br /> arise under this Act. ' <br /> The attached resolution establishes an Americans with <br /> Disabilities Commission to review and resolve complaints from <br /> citizens which may arise under the Act. The seven member <br /> Commission should decrease the number of complaints which will <br /> be filed with the Equal Employment Opportunity Commission and <br /> the Justice Department. <br /> <br /> <br />
