The Virginia Department of Mental Health, Mental Retardation and Substance <br />Abuse Services (DMHMRSAS) provides funds on an annual basis to all Community <br />Services Boards including BHS to serve persons found Not Guilty by Reason of Insanity <br />(NGRI) who have been discharged into the community from a state institution. <br /> <br />Discussion: <br />. The Discharge Assistance funds are utilized for the ongoing management of <br />acquittees in the community to ensure compliance with treatment and court ordered <br />activities. <br /> <br />Financial Impact: <br />. There is no financial impact on the City. <br /> <br />Staff Recommends: <br />Adoption of proposed ordinance. Vision Principle: Thriving Neighborhoods and a <br />Sense of Community <br /> <br />Next Steps Following Council Action: <br />. Pending approval, the Director of BHS will ensure the funds are utilized to <br />provide services to NGRI acquittees. <br /> <br />07 -240-3: <br /> <br />Background: <br />. The Department of Mental Health, Mental Retardation and Substance Abuse <br />Services (DMHMRSAS) is allocating an additional $7,806 through a contract <br />modification agreement to the Local Contract for State Fiscal Year (SFY) 2007 <br />Continuing Participation in Part C. <br />. This contract is executed between DMHMRSAS and the Portsmouth Department <br />of Behavioral Healthcare Services (BHS). <br /> <br />Discussion: <br />. Part C services are provided through Part C of the Individuals with Disabilities <br />Education Act (IDEA) (20 U.S. C. 1431et Seq.), as amended, and are designed to meet <br />the developmental needs of each eligible child and the needs of the family related to <br />enhancing the child's development and are provided to children from birth to age three <br />who have (i) a twenty-five percent developmental delay in one or more areas of <br />development, (ii) atypical development, or (iii) a diagnosed physical or mental condition <br />that has a high probability of resulting in developmental delay. <br /> <br />Financial Impact: <br />. There is no financial impact to the city. <br /> <br />Staff Recommends: <br />Adoption of proposed ordinance. Pending approval, the Director of BHS will ensure funds are properly dispersed <br />and are used to fund the provision of direct services to Part C eligible children with a <br />focus on addressing the barriers to serving all eligible children, and for supporting <br />service enhancement strategies related to identified compliance issues. <br />
