Pending approval, the Sheriff will assign these two Deputy Sheriffs to the <br />General District Court <br /> <br />Motion by Mr. Heretick, and seconded by Mr. R Smith, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE APPROPRIATING $83,350 IN THE FY 2007-2008 GENERAL FUND <br />FOR THE COST OF TWO ADDITIONAL DEPUTY SHERIFFS IN THE GENERAL <br />DISTRICT COURT." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R Smith, Holley <br />Nays: None <br /> <br />07 - 243 - Adoption of a resolution, adopted after public hearing conducted pursuant to <br />Section 15.2-1903(B) of the Code of Virginia, authorizing the acquisition of real property <br />with the street address of 1128 Harrell Street, Portsmouth, Virginia, commonly known <br />as the "Crab Shack," plus adjacent properties owned by the Park View Home Company, <br />for a public park to provide public waterfront access, and authorizing the use of the <br />power of eminent domain for this purpose, if necessary. Vision Principle: Thriving <br />Neighborhoods and a Sense of Community <br /> <br />Background: <br />. A public park is needed in this part of the city as a neighborhood enhancement, <br />and also to provide additional public water access for our citizens. This property will be <br />acquired for that purpose. <br /> <br />Discussion: <br />. The property is adjacent to certain property already owned by the City. <br />. Upon acquisition, it will be combined with the already-owned property to create a <br />neighborhood park that also provides public water access for citizens. <br />. Negotiations will be conducted by PRHA as agent for the City, working with the <br />City Attorney. The power of eminent domain will be authorized for this acquisition, to be <br />used if necessary. <br />. The acquisition is expected to be complete during FY 2007-08. <br /> <br />Financial Impact: <br />. The City will pay fair market value ("FMV") to acquire this property. There will <br />also be administrative costs not expected to exceed $15,000 associated with the <br />acquisition. While assessed value is not always an absolute indicator of FMV, the <br />current assessed value is $128,420. Once more accurate information about FMV is <br />obtained, it will be provided to Council so that acquisition funding can be included in <br />next year's budget Once the property is acquired and the park is complete, it is <br />expected to increase the assessed value of homes in the neighborhood, resulting in an <br />indeterminate amount of additional tax revenue every year thereafter. <br /> <br />Staff Recommends: <br />Adoption of proposed resolution.
