February 13. 2007 (a) Any changes to the exterior of the building during renovation shall conform to standards as set forth by the Downtown Design Committee. (b) The site layout plan shall generally be in accordance with the site plan dated October 10, 2006. (c) Seating capacity shall not exceed the amount shown in the site plan submitted October 10, 2006. (d) Hours of operation shall be limited to the hours between 9:00 a.m. and 2:00 a.m., Monday through Sunday. (e) The applicant shall utilize commercial garbage collection that employs an inside container, which has been approved by General Services. (f) The establishment shall be operated in compliance with all applicable codes, ordinances, and regulations of federal, state, and local governments. (g) The applicant shall obtain all required licenses and permits before operation and these licenses and permits shall remain in effect during the operation of the establ ishment. (h) Taxes and fees associated with the property shall be paid when due. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley Nays: None - Other Unfinished Business - 06 - 511 - Rezoning: (a) Z-06-04 COUNTY STREET CORRIDOR - Bethel Temple Church proposes to rezone property located at 620 Constitution Avenue for the purpose of church expansion from Downtown, D-2, Industrial to Downtown, D-2, Office. Deferred from the November 14, 2006 Council Meeting. Vision Principle: Neighborhood and Community Transformation. Motion by Ms. Psimas, and seconded by Mr. D. Smith, to accept the applicant's letter of withdrawal of item Z-06-04, and was adopted by the following vote: Ayes: Heretick, Moody, Psi mas, Randall, R. Smith, Holley Nays: None Absent: D. Smith - City Manager's Report - 07 - 72 - Adoption of an ordinance accepting a grant in the amount of $75,000 from the Virginia Department of Historic Resources and appropriating said amount in the FY 2006-2007 Grants Fund Budget for the construction of a new Nature Center at the Hoffler Creek Wildlife Preserve.
