Smith, Holley <br />Nays: None <br /> <br />(e) CA-06-01 <br /> <br />CITY WIDE - The City of Portsmouth requests a Code Amendment <br />to Chapter 40 of the City Code to: <br /> <br />1. Modify the term Group Housing Use Permit to Housing Use <br />Permit to eliminate confusion between multi-family projects and true <br />group homes, <br /> <br />2. Remove the requirement in the zoning ordinance that <br />mandates conversions of existing residential units to condominium <br />units to obtain a Group Housing Use Permit, <br /> <br />3. Extend the expiration time of a Group Housing Use Permit <br />from one year to two years and; <br /> <br />4. Modify sections of Chapter 40 dealing with nonconforming <br />uses, structures and lots to be in compliance with the State Code of <br />the Commonwealth of Virginia. Vision Principle: Neighborhood <br />and Community Transformation and Robust and Prospering <br />Economy. <br /> <br />Motion by Mr. Heretick, and seconded by Mr. D. Smith, to concur with the <br />recommendation of the Planning Commission that CA-06-01 be approved on first <br />reading, and was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley <br />Nays: None <br /> <br />- Unfinished Business - <br /> <br />06 - 511 - Rezoning and use permit: <br /> <br />06-511 (b): <br /> <br />Motion by Mr. D. Smith, and seconded by Ms. Psimas, to refer Item Z-06-05 back <br />to the Planning Commission, and was adopted by the following vote: <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley <br />Nays: None <br /> <br />Motion by Mr. Moody, and seconded by Ms. Randall, to adopt the following <br />resolution approved on first reading at the November 14, 2006 meeting, and was <br />adopted by the following vote: <br /> <br />06 - 511 (c): <br /> <br />"RESOLUTION GRANTING A USE PERMIT TO ST. MARK MISSIONARY BAPTIST <br />CHURCH TO OPERATE A RELIGIOUS-BASED CHILD CARE CENTER AT 2714 <br />FREDERICK BOULEVARD. <br /> <br />WHEREAS, Pastor Curtis E. Edmonds, Sr., has made application on behalf of <br />St. Mark Missionary Baptist Church pursuant to Section 40-43.1 of the Code of the City <br />of Portsmouth, Virginia (1988) for the granting of a use permit for the operation of a <br />religious-based child care center at 2714 Frederick Boulevard, Portsmouth, Virginia; <br />and <br /> <br />WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br />
