May 25, 1993 93-174 Use Permit and Group Housing Project Applications. (A) (UP-93-03) Motion by Mr. Epperson, and seconded by Mr. King, the following resolution approved at the Public Hearing of May 12, 1993, was adopted and by the following vote: "A RESOLUTION GRANTING A USE PERMIT TO OPERATE A CHILD DAY CARE SERVICES FACILITY AT 1220 CAVALIER BOULEVARD WHEREAS, Sandra Pinnock, contract purchaser of 1220 Cavalier Boulevard, has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia, 1988, as amended, for granting of a use permit to operate a child day care services facility at 1220 Cavalier Boulevard, Portsmouth, Virginia; and WHEREAS, the applicant and the Planning Director have done all things-'required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit, with conditions. Now, THEREFORE, BE IT RESOLVED by the Council of the CitY of Portsmouth, Virginia: 1. That the use for which the use permit hereinafter described is sought: (a) will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will nOt be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and ~ curb cuts which will provide~for safe and convenient traffic movement; and ~ (e) Will be in accordance with the purposes of the : Zoning Chapter of the City Code. That Sandra Pinnock is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City Portsmouth, Virginiat 1988, t~ operate a child day care services facility at 1220 Cavalier Boulevard~ said property being more particularly described as follows: UP-93-3 of Beginning on the west right-of-way of Cavalier Boulevard 170' more or less north from its intersection with the north right-of-way of Tazewell Street; thence west 150' to a point; thence north 150' to a point; thence east 150' to the west right-of-way of Cavalier Boulevard~ thence south along said right-of-way 150' to the point of beginning.
