<br />AUQust 22, 2006 <br /> <br />Next Steps Following Council Action: <br />. If the additional funds are appropriated, the Director of BHS will ensure the funds <br />are budgeted in the FY07 Part C program for the provision of early intervention <br />services; <br />. The City Manager will execute the Contract Modification Agreement with <br />DMHMRSAS. <br /> <br />Motion by Mr. R. Smith, and seconded by Mr. Heretick, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE ACCEPTING $68,766 FROM THE COMMONWEALTH OF VIRGINIA <br />DEPARTMENT OF MENTAL HEALTH MENTAL RETARDATION AND SUBSTANCE <br />ABUSE SERVICES AND APPROPRIATING SAID AMOUNT IN THE FY 2006-2007 <br />BEHAVIORAL HEAL THCARE SERVICES FUND OPERATING BUDGET FOR PART <br />C EARLY INTERVENTION SERVICES FOR INFANTS AND TODDLERS." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, D. Smith, R. Smith, Holley <br />Nays: None <br /> <br />06 - 385 - Adoption of an ordinance to amend Article XXI of Chapter 2 of the Code of <br />the City of Portsmouth (1988), pertaining to the Emergency Services Agency. Vision <br />Principle: Bold New Directions. <br /> <br />Background: <br />. Experience with several recent natural disasters and the possibility of previously <br />unprecedented terrorist activities have demonstrated the need for a comprehensive <br />review and update of the City's laws for responding to local emergencies. This <br />proposed revision of the City's Emergency Services Agency corrects certain outdated <br />material and provides a clearer and more comprehensive set of operating procedures <br />by which the City can protect its citizens during an emergency. <br /> <br />Discussion: <br />. The Emergency Services Agency is renamed the "Emergency Management <br />Agency" for consistency with State Statute terminology. <br />. Procedures for declaring a local emergency are clarified. <br />. Emergency powers are clearly stated. <br />. A chain of command and an order of succession are established. <br />. There are enhanced standards for maintaining written records. <br />. Enhanced cooperation and coordination with independent agencies. <br />. Financial Impact: There is no immediate cost. The enhanced standards for <br />maintaining written records should aid in securing future reimbursement from federal <br />and state emergency agencies. <br /> <br />Staff Recommends: <br />Adoption of proposed ordinance. Vision Principle: Bold New Directions. <br /> <br />Next Steps Following Council Action: <br />. Transmit to Municipal Code Commission for inclusion in City Code. <br />. Transmit to leadership of city's emergency management team. <br /> <br />Motion by Mr. R. Smith, and seconded by Ms. Randall, to adopt the following <br />ordinance. <br /> <br />Amended motion by Mr. D. Smith, and seconded by Ms. Psimas, to adopt the <br />following ordinance amending #9 to read: "Direct the evacuation of areas of the City. It <br />shall be the duty of each citizen to obey any evacuation order made hereunder, unless <br />the citizen has good cause for not doing so. There shall be no criminal sanction for a <br />citizen who chooses not to evacuate", and was adopted by the following vote: <br />
