1,92 <br /> <br />September 28, 1993 <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said use permit, with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the use permit hereinafter <br />described is sought: <br /> <br />(a) Will not adversely affect the health and safety of persons <br />residing or working in the neighborhood of the proposed use; <br /> <br />(b) Will not be detrimental to the public use or injurious to <br />the property or improvements in the neighborhood; <br /> <br />(c) Will be provided with sufficient landscaping to insure <br />compatibility with surrounding uses; <br /> <br />(d) Will be a project that will be developed according to a <br />plan for parking, driveways, and curb cuts which will provide <br />for safe and convenient traffic movement; and <br /> <br />(e) Will be in accordance with the purposes of the Zoning <br />Chapter of the City Code. <br /> <br /> 2. That Regional Hospital Services is hereby granted a <br />use permit pursuant to Section 40-43.1 of the Code of the City <br />of Portsmouth, Virginia, 1988, to operate a regulated medical <br />waste treatment facility at 3530 Elmhurst Lane, said property <br />being more particularly described as follows: <br /> <br />UP-93-10 <br /> <br /> Beginning on the east right-of-way line of Elml~urst Lane a <br />distance of 417.67 feet southeasterly from its intersection <br />with the south right-of-way line of the Seaboard Coast Line <br />Railroad; thence easterly 391.56 feet to the eastern terminus <br />of Rowley Street (a paper street); thence southeasterly 369.11 <br />feet to the east right-of-way line of El~urst Lane; thence <br />northwest along said right-of-way 549.52 feet to the point of <br />origin. <br /> <br /> 3. That the use permit is approved subject <br />following conditions: <br /> <br />(a) The <br />Services <br /> <br /> to the <br /> <br />use permit shall be issued to Regional Hospital <br />and is not transferable. <br /> <br />(b) The <br />hospital <br />treated. <br /> <br />use permit shall be limited to treatment of regulated <br />waste (red bag) only. No other materials shall be <br /> <br />(c) All applicable federal, state and local codes and <br />licensing requirements shall be met, and all required permits <br />shall be obtained and maintained. <br /> <br />(d) Ingress and egress for the proposed facility shall be <br />shared with the Shared Hospital Services laundry facility. <br /> <br />(e) There shall be no outside storage. <br /> <br />(f) The building shall be a one-story brick front facade <br />structure. <br /> <br />(g) Ail landscaping shall be in accordance with the <br />landscaping requirements of the Zoning Ordinance and the Tree <br />Planting and Replacement Ordinance. A site plan must be <br />reviewed and approved by the Planning Director prior to the <br />issuance of a building permit." <br /> <br />Ayes: Epperson, Griffin, Hawks, King, Pitts, Webb <br />Nays: Clemons <br /> <br /> <br />
