1,92 September 28, 1993 WHEREAS, the Planning Commission has recommended the granting of said use permit, with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit hereinafter described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. That Regional Hospital Services is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia, 1988, to operate a regulated medical waste treatment facility at 3530 Elmhurst Lane, said property being more particularly described as follows: UP-93-10 Beginning on the east right-of-way line of Elml~urst Lane a distance of 417.67 feet southeasterly from its intersection with the south right-of-way line of the Seaboard Coast Line Railroad; thence easterly 391.56 feet to the eastern terminus of Rowley Street (a paper street); thence southeasterly 369.11 feet to the east right-of-way line of El~urst Lane; thence northwest along said right-of-way 549.52 feet to the point of origin. 3. That the use permit is approved subject following conditions: (a) The Services to the use permit shall be issued to Regional Hospital and is not transferable. (b) The hospital treated. use permit shall be limited to treatment of regulated waste (red bag) only.
