That the use permit is approved subject to the following condition which <br />shall be observed by the applicants and any successor in interest: <br /> <br />The applicants shall comply with all applicable codes, ordinances and regulations of <br />federal, state and local governments and shall obtain and maintain in effect all <br />necessary licenses and permits. <br /> <br />4. Smith, Holley <br />Nays: None <br /> <br />- Other Unfinished Business - <br /> <br />06 - 205 - Adoption of an ordinance to amend Section 30-236(b) of the City Code <br />pertaining to mandatory retirement age for members of the Portsmouth Fire and Police <br />Retirement System, whereby the mandatory retirement age shall be changed from sixty <br />two (62) to seventy (70). Deferred from the July 11, 2006 Council Meeting. Vision <br />Principle: Bold New Directions. <br /> <br />Background: <br />. On April 13, 2006, the Portsmouth Retirement Board unanimously adopted a <br />motion recommending that City Council amend the City Code so as to change the <br />mandatory retirement age for members of the Portsmouth Fire and Police Retirement <br />System from age 62 to 70 and has assigned responsibility for enforcement of mandatory <br />retirement to the Secretary of the Retirement Board. Age 70 is also the VRS mandatory <br />retirement age. <br />. Enclosed for your reference, is a copy of the minutes from the April 13th <br />Portsmouth Retirement Board Meeting. <br />. Per the recommendation of the Retirement Board, Management presented you <br />with this code amendment during the May 9,2006 City Council meeting. <br />. During that meeting, City Council tabled this matter until July 2006, and the Mayor <br />requested that former City Councilman Charles Whitehurst and Councilman Ray Smith <br />both serve as Council liaisons to meet with the City Manager on this matter. <br />. The Council liaisons met with City Management as requested and the general <br />consensus from that meeting was that Council should adopt this ordinance thus changing <br />the mandatory retirement age from 62 to 70. <br />. Mercer, the City's retirement actuarial consultant, has also reviewed this matter <br />and their letter dated May 9, 2006 is enclosed for your reference. Mercer concluded that <br />such a change would save the retirement system money, which is very important. <br /> <br />Discussion: <br />. All police and fire personnel, regardless of age must be fit for duty. The ability to <br />meet the physical requirements of the job is a function of one's lifestyle and exercise <br />regimen and not age. <br />. Those public safety employees who fail to meet applicable medical standards, <br />regardless of their age, face appropriate employment action. <br />. Per your direction, this matter is placed back on your agenda for consideration. <br />. Financial Impact: This change will have a positive financial impact on the City. <br /> <br />Staff Recommends: <br />Adopt the recommendation of the Retirement Board, and Adoption of an ordinance to <br />amend Section 30-236 (B) of the City Code pertaining to mandatory retirement age for <br />members of the Portsmouth Fire and Police Retirement System, whereby the mandatory <br />retirement age shall be changed from sixty two (62) to seventy (70).
