June 13, 2006 8. Vanessa Fields, 1513 Summit Avenue, asked for help in improving the quality of life for residents on Summit Avenue. - Unfinished Business - 06 - 229 - Use permit application: Motion by Mr. Whitehurst, and seconded by Mr. Moody, to adopt the following resolution approved on first reading at the May 23, 2006 meeting, and was adopted by the following vote: 06 - 229(a): "RESOLUTION GRANTING APPROVAL OF A GROUP HOUSING USE PERMIT (GHP-06-08) TO DAN E. GRIFFIN FOR FOUR RESIDENTIAL TOWNHOUSE UNITS AT 4122-4130 GREENWOOD DRIVE. WHEREAS, Dan E. Griffin, pursuant to Section 40-112 of the Code of the City of Portsmouth, Virginia (1988), as amended, has made application for the approval and granting of a group housing use permit for four residential townhouse units at 4122- 4130 Greenwood Drive, Portsmouth, Virginia; and WHEREAS, the subject property is furthermore described as: GHP-06-08 Beginning approximately 104.85 feet east of the intersection of Greenwood Drive and Clay Street along the northern right-of-way line of Greenwood Drive; thence north approximately 167.57 feet to a point; thence east approximately 43.58 feet to a point; thence southeast approximately 128.03 feet to a point; thence southwest approximately 59.43 to the northern right of way line of Greenwood Drive; thence west approximately 100 feet along the northern right-of-way line of Greenwood Drive to the point of beginning. and WHEREAS, the Planning Commission has reviewed such application and site plan submitted therewith and has recommended conditional approval of said application; and WHEREAS, the applicant has been informed that approval of the group housing project pursuant to Section 40-116 only grants an exemption from certain requirements for residences as stated in said section and does not constitute a waiver of any other requirement embodied in the Subdivision Ordinance, Zoning Ordinance, Code of the City of Portsmouth, Virginia, or any other applicable local, state or federal law or regulation; and WHEREAS, the applicant is aware that building permits and any other required permit will be issued only upon compliance with the ordinances, laws or regulations applicable thereto. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That, coupled with the terms imposed by paragraph 2 hereof, the following conditions exist:
