<br />June 13, 2006 <br /> <br />Discussion: <br />. An ERS classification is for a single five-year period, commencing on the date <br />that the Virginia Department of Environmental Quality issues a Certification of Voluntary <br />Completion for the property. It is effective for the entire calendar year, without pro <br />rating, and no property shall be eligible for the classification for any year prior to 2006. <br />. The classification will apply to the full assessed value of land and improvements <br />on any qualified property. The property owner has the sole burden to provide the City <br />with proper documentation of eligibility during each applicable tax year to the City <br />Assessor. <br />. If the owner of any property classified as an ERS fails to pay any other taxes <br />legally owed to the City in a timely manner, then the City will deem that the property <br />owner has waived his or her claim to the ERS classification - applicable for the tax year <br />in question and all subsequent tax years for which the property would otherwise qualify <br />for an exemption (this is irrevocable, regardless of change of ownership). <br />. Financial Impact: There is no measurable financial impact on the City at this <br />time. <br /> <br />Staff Recommends: <br />Adoption of an Ordinance to authorize real estate tax abatement for environmental <br />restoration sites by enacting Section 35-135 of the City Code. Vision Principle: Bold <br />New Directions. <br /> <br />Next Steps Following Council Action: <br />. Provide Ordinance to Municipal Code Commission for inclusion in the City Code, <br />and also provide Ordinance to the City Assessor, who will handle all request for tax <br />abatement. <br /> <br />Motion by Ms. Psi mas, and seconded by Mr. Heretick, to adopt the following <br />ordinance, and was adopted by the following vote: <br /> <br />"ORDINANCE TO AUTHORIZE CERTAIN REAL ESTATE TAX ABATEMENT FOR <br />ENVIRONMENTAL RESTORATION SITES BY ENACTING SECTION 35-135 OF THE <br />CODE OF THE CITY OF PORTSMOUTH." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />06 - 264 - Adoption of an ordinance to increase expenditure appropriations for <br />therapeutic foster care and various other program costs and estimated revenues by <br />$1,483,591, including state reimbursement revenues of $994,076 and a "local match" <br />transfer from the General Fund of $489,515, in the Comprehensive Services Act Fund <br />Operating Budget for Fiscal Year 2005-2006. Vision Principle: Neighborhood and <br />Community Transformation. <br /> <br />Background: <br />. The agency's therapeutic foster care costs, which comprise 74% of the program <br />costs in Fiscal Year 2006, have increased by 39% over Fiscal Year 2004-2005. The <br />number of clients served by these programs has increased by 70% within the current <br />fiscal year as compared to the prior fiscal year. <br />. $1,483,591 of additional expenditure budgetary authority is requested to pay <br />health providers for the increase level of services currently projected in Fiscal Year <br />2005-2006. <br /> <br />Discussion: <br />. The additional funding will enable the CSA fund to pay for all outstanding <br />services rendered to CSA clients during Fiscal Year 2006. <br />
