<br />May 23. 2006 <br /> <br />'" City Manager Oliver informed Council that provisions had been made in the <br />budget to have Management come up with a plan to identify those critical <br />neighborhoods and engineers are working on that master plan. He also informed <br />Council once that master plan has been developed there will be public work <br />sessions allowing Council, at that time, to set the priorities. <br /> <br />7. Raleigh Harsley, 2124 Peach Street, voiced his concern with regards to small <br />children playing in the streets. <br /> <br />8. Amanda Connor, 3308 Armistead Drive, asked that Council not approve a halfway <br />house for felons in her neighborhood. <br /> <br />- Unfinished Business - <br /> <br />06 - 203 - Use permit applications: <br /> <br />Motion by Mr. Whitehurst, and seconded by Mr. Moody, to adopt the following <br />resolution approved on first reading at the May 9,2006 meeting, and was adopted by <br />the following vote: <br /> <br />06 - 203(a): <br /> <br />"RESOLUTION GRANTING APPROVAL OF A GROUP HOUSING USE PERMIT <br />(GHP-06-06) TO ROBERT H. DE FORD, III, FOR 36 RESIDENTIAL CONDOMINIUM <br />UNITS AT 3993 TWIN PINES ROAD. <br /> <br />WHEREAS, Hoggard Eure Associates, P.C., on behalf of Robert H. De Ford, III, <br />has made application for the approval and granting of a group housing use permit for 36 <br />residential condominium units at 3993 Twin Pines Road, Portsmouth, Virginia, pursuant <br />to Section 40-112 of the Code of the City of Portsmouth, Virginia (1988), as amended; <br />and <br /> <br />WHEREAS, the subject property is furthermore described as: <br /> <br />GHP-06-06 <br /> <br />3993 Twin Pines Road <br /> <br />Beginning at a point 667.5':t northeast of the northeast corner of Twin Pines Road <br />and Gateway Drive; thence, in a northeasterly direction 346':t to a point; thence, in an <br />southeasterly direction 505':t to a point; thence, in a southwesterly direction 210.3 :t to a <br />point; thence, in a northwesterly direction 505':t to a point of the beginning. <br /> <br />and <br /> <br />WHEREAS, the Planning Commission has reviewed such application and site <br />plan submitted therewith and has recommended conditional approval of said <br />application; and <br /> <br />WHEREAS, the applicant has been informed that approval of the group housing <br />project pursuant to Section 40-116 only grants an exemption from certain requirements <br />for residences as stated in said section and does not constitute a waiver of any other <br />requirement embodied in the Subdivision Ordinance, Zoning Ordinance, Code of the <br />City of Portsmouth, Virginia, or any other applicable local, state or federal law or <br />regulation; and <br />
