December 13, 1993 At a Called Meeting of the City Council held on Monday, December 13, 1993, there were present: Mayor Gloria O. Webb, Vice Mayor Lee E. King, *Johnny M. Clemons, John H. Epperson, Bernard D. Griffin, Sr., James C. Hawks, Cameron C. Pitts, V. Wayne Orton, City Manager, Stuart E. Katz, City Attorney. 93-472 - The following call for the meeting was read: "Please attend a Called Meeting of held in the City Council Chamber, 6th floor of City Hall, Crawford Street, at 5:00 p.m., Monday, December 13, 1993, the purpose of a Public Work Session. the City Council to be 801 for In addition, you may consider a motion to go into an Executive Session. By order of the Mayor." 93-474 - The following item was discussed in the Public Work Session: 1. Elizabeth~iver Oil Spill Motion by Mr. Clemons, and seconded by Mr. Griffin to go into Executive Session pursuant to provisions of Section 2.1-344 of the Code of Virginia for the following: (1) Consideration of appointments to Boards and Commissions by the City Council as permitted under Subsection (A) (1) ~ (2) Discussion or consideration of a personnel matter concerning the City Manager as permitted under subsection (A) (1); (3) Discussion or consideration of the disposition of publicly held property, or the use of sa/ne, in the Downtown and Churchland portions of the City as permitted under Subsection (A) (3). (4) Consultation with the City Attorney, and briefings by staff members, pertaining to a request from SPSA requiring legal advice, as permitted under Subsection (A)(7), and matters of actual litigation, James vs. The City of Portsmouth. The motion was adopted by unanimous vote. Motion by Mr. Epperson, and seconded by Mr. Griffin, pursuant to Section 2.1-344.1 of the Code of Virginia certifying that to the best of the Council member's knowledge during the immediately preceding Executive Session of the City Council: (1) Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and (2) Only such public business matters as were identified in the motion by which the Executive Session was convened, were heard, discussed, or considered in the meeting by the City Council.
