May 9.2006

Discussion:
. The Retirement Board, in its desire to rectify this inconsistency, has been fully
briefed by the CFO, the Director of Human Resources and the City Attorney's office
after having fully researched and discussed the relevant facts, circumstances and
supporting data regarding this matter.
. Therefore, the Retirement Board has unanimously recommended to City Council
the adoption this ordinance.
. Such a waiver will enable eligible retirees to forego the vocational rehabilitation
requirement.
. Financial Impact: A net reduction in workers compensation claims costs due to
increased participation in vocational rehabilitation and a net reduction in retirement
allowance payments due to increased coordination of benefits between the workers'
compensation program and the City's retirement plans.

Staff Recommends:
Adoption of an Ordinance to amend City Code Sections 30-121.1 and 30-214.1
regarding the waiver of Workers' Compensation vocational rehabilitation for retirees with
compensable service-connected disabilities meeting the full service retirement eligibility
requirements of either the Portsmouth Supplemental Retirement System or the
Portsmouth Fire & Police Retirement System. Vision Principle: Bold New Directions.

Next Steps Following Council Action:
. The CFO and City Attorney will facilitate the Retirement Board's compliance with
this ordinance.

Motion by Mr. Whitehurst, and seconded by Mr. Smith, to adopt the following
ordinance, and was adopted by the following vote:

"ORDINANCE TO AMEND CHAPTER 30 OF THE CODE OF THE CITY OF
PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 30-121 AND 30-241
THEREOF PERTAINING TO VOCATIONAL REHABILITATION REQUIREMENTS
FOR CERTAIN SERVICE-CONNECTED DISABILITY RETIREES."

Ayes: Heretick, Moody, Randall, Smith, Whitehurst, Holley
Nays: None

- New Business -

06 - 207 - Boards and Commissions

There were no appointments.

06 - 208 - Items Submitted by Council Members

'" Mr. Whitehurst announced the success of the March of Dimes walk and the
Notables Banquet which were both on Saturday, May 6, 2006.

'" Ms. Randall wanted to acknowledge the excellent performance of the
students from the Portsmouth Public Schools at the Notables Banquet.

'" Mr. Smith informed citizens that he and Mr. Whitehurst had been appointed
as liaisons to the Supplemental Retirement Board by Mayor Holley.
