<br />April 18. 2006 <br /> <br />9. Fred Schoenfeld, 415 North Street, spoke in opposition to several items contained in <br />the Operating Budget. <br /> <br />10. Jerry Rogers, 4630 West Norfolk Road, spoke in opposition to several items <br />contained in the Operating Budget. <br /> <br />11. Ronald Reed, 5911 Bertrand Street, spoke in opposition to the increased real estate <br />tax rate. <br /> <br />12. James Mayo, 4424 Seagrove Road, spoke in opposition to the increased real estate <br />tax rate. <br /> <br />13. Dr. David Stuckwisch, Superintendent of Schools,801 Crawford Street, 3rd Floor, <br />spoke in support of the school funding contained in the proposed budget. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Whitehurst, asking the City Manager <br />and Staff to make adjustments to the budget that would support an additional six cent <br />tax rate reduction. <br /> <br />Councilman Smith called for a point of order and asked that Council continue <br />with the public hearing. <br /> <br />Mayor Holley asked that City Attorney Oksman advise the Council as to whether <br />or not the motion made by Councilman Moody is out of order. <br /> <br />City Attorney Oksman advised Council that it was not appropriate to make a <br />motion during a public hearing. <br /> <br />Vice Mayor Moody withdrew his motion to be restated at the conclusion of the <br />public hearing. <br /> <br />14. Byron Kloeppel, School Board Chairman, 801 Crawford Street, 3rd Floor, spoke in <br />support of this item. <br /> <br />15. Sharon Anderson, 6005 Dunkirk Street, asked if the Ebony Heights neighborhood <br />was included in the CIP. <br /> <br />16. Edward Ellis, 3117 Rolen Road, spoke in opposition to the increased real estate tax <br />rate. <br /> <br />Motion by Mr. Moody, and seconded by Mr. Whitehurst, asking the City Manager <br />and Staff to make adjustments to the budget that would support an additional six cent <br />tax rate reduction. <br /> <br />Councilman Smith asked that City Attorney Oksman give his opinion as to <br />whether or not the motion made by Vice Mayor Moody was out of order. <br /> <br />City Attorney Oksman stated that it was his opinion that the motion would be out <br />of order for two reasons. First, this is not a regular meeting of Council; it is a Special <br />meeting for certain purposes. The law provides that at a Special meeting of Council no <br />business shall be conducted which was not contained in the notice of the meeting. <br />Secondly, the motion made by Councilman Moody does not provide a corresponding <br />reduction in expenditures leading to an unbalanced budget. <br />
