<br />April 11. 2006 <br /> <br />(c) Site development shall be in general compliance with the document titled <br />"Site Layout Plan, Group Housing Permit, Belle Hall Apartments," dated February 17, <br />2006 and on file in the Department of Planning and Zoning. The Director of Planning <br />may approve minor modifications. <br /> <br />(d) Landscaping Design shall be in general compliance with the document <br />titled "Landscaping Plan, Group Housing Permit, Belle Hall Apartments," dated February <br />17, 2006 and on file in the Department of Planning and Zoning. The Director of <br />Planning may approve minor modifications. <br /> <br />(e) Existing mature vegetation within the delineated wetlands buffer along the <br />eastern and western property lines as shown on the above-referenced Site Layout Plan <br />shall remain in natural state. <br /> <br />(f) A site plan shall be submitted and approved by the Department of <br />Engineering before construction. <br /> <br />(g) The developer shall be responsible for costs associated with utility <br />upgrades deemed necessary by the Director of Public Utilities, including but not limited <br />to possible water, sewer, andlor stormwater facilities for the community. <br /> <br />(h) The applicant shall comply with all applicable codes, ordinances and <br />regulations of federal, state and local governments and shall obtain all necessary <br />licenses and permits. <br /> <br />(i) All taxes owed on or in connection with the subject property shall be paid <br />in a timely manner. <br /> <br />3. EXPIRATION OF PERMIT: Unless extended as provided under Section <br />40-115 of the Code of the City of Portsmouth, Virginia (1988), the group housing use <br />permit shall expire for any portion of the approved project for which building permits <br />have not been issued if the applicant fails to apply for all building permits for the entire <br />project within one year of the adoption of this resolution. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the permit by the City Council." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Whitehurst, Holley <br />Nays: None <br /> <br />- City Manager's Report - <br /> <br />06 - 167 - Adoption of a resolution requesting transfer of $ 1,489,840 in funds previously <br />allocated to the Tidewater Community College Street Infrastructure from the Virginia <br />Department of Transportation Fiscal Year 2005-2006, Revenue Sharing Program to the <br />Victory Blvd. Improvements project. This $1,489,840 is inclusive of the City Share of <br />$744,920 and the VDOT share of $744,920. Vision Principle: Neighborhood and <br />Community Transformation. <br /> <br />Background: <br />. Due to a delay in receipt of the signed CitylState agreement for the Victory Blvd. <br />Improvement project, a contract could not be issued to the low bidder on the contract <br />within 90 days of the bid opening. <br />. The low bidder is bound by contract to honor his bid for 90 days from the date of <br />the bid opening. <br />. As a result the contractor (W. R. Hall) chose to withdraw his bid. <br />
