<br />March 21. 2006 <br /> <br />(a) Building construction shall be in compliance with the site plan and elevations <br />submitted (see plans dated 01-06-06). Minor modifications may be approved by the <br />Director of Planning. <br /> <br />(b) Building materials shall be 30-year architectural shingles, and a mixture of vinyl <br />siding, hardi-plank, and cultured stone as detailed in the application for Group Housing <br />Permit and illustrated on the elevations (dated 01-06-06). <br /> <br />(c) Landscaping shall be installed and maintained in general compliance with the <br />submitted Landscape Plan (dated 10-28-05) and Typical Building Plantings Scheme <br />dated (10-28-05). <br /> <br />(d) Final signage shall be in general compliance with the illustrations provided. The <br />final sign product shall be reviewed and approved by the Director of Planning before <br />installation in the community. <br /> <br />(e) A site plan shall be submitted and approved by the Department of Engineering <br />before construction. A final tree saving plan shall be included with the site plan for <br />review and approval by the City Arborist. <br /> <br />(f) A community walking trail shall be installed and maintained in compliance with <br />the Preliminary Site Plan (dated 10-28-05). Final plans for an environmentally-sensitive <br />walking trail within the Chesapeake Bay Resource Protection Area shall be submitted <br />and approved by the Chesapeake Bay Program Administrator. <br /> <br />(g) The developer shall be responsible for costs associated with utility upgrades <br />deemed necessary by the Director of Public Utilities, including but not limited to possible <br />water, sewer, andlor stormwater facilities for the community. <br /> <br />(h) The project shall be developed and maintained in compliance with all applicable <br />codes, ordinances, and regulations of federal, state, and local governments, and all <br />required licenses and permits shall be obtained and remain in effect during the <br />development of this project.. <br /> <br />(i) All taxes owed on or in connection with the subject property shall be paid when <br />due. <br /> <br />3. EXPIRATION OF PERMIT: Unless extended as provided under Section <br />40-115 of the Code of the City of Portsmouth, Virginia (1988), the group housing use <br />permit shall expire for any portion of the approved project for which building permits <br />have not been issued if the applicant fails to apply for all building permits for the entire <br />project within one year of the adoption of this resolution. <br /> <br />4.
