<br />February 28. 2006 <br /> <br />(d) The quantity, quality, utility, size and type of the project's open space and <br />landscaping improvements is sufficient to offset the decreases in dimensional <br />requirements or other deviations from the zoning district in which the project is located; <br /> <br />(e) The project will not cause surrounding streets and roads to exceed their <br />safe capacities; <br /> <br />(f) The quantity, quality, utility and type of the project's community and <br />common facilities are sufficient to offset the decreases in dimensional requirements and <br />other deviations from the zoning district in which the project is located; <br /> <br />(g) The project complies with the standards for approval of a use permit set <br />forth in Section 40-106 of the Code of the City of Portsmouth, Virginia; and <br /> <br />(h) The project provides parking, building access and pathways for persons <br />with disabilities in accordance with the requirements of the Americans with Disabilities <br />Act. <br /> <br />2. That a group housing use permit for the conversion of 240 existing <br />apartment units into 240 residential condominium units is hereby granted to the <br />applicant subject to the following terms and conditions that shall be observed by the <br />applicant and any successor in interest: <br /> <br />(a) The property owner shall not, by any means, expand the nonconforming <br />use. Expansion of this nonconforming multifamily housing project shall result in the <br />requirement to adhere to City Code Section 40-111 (Group Housing Use Permits). <br /> <br />(b) Upon the adoption of the Group Housing Use Permit Resolution, the <br />project shall submit to the Site Plan Review Process. The project shall comply with the <br />approved site plan. <br /> <br />(c) The property owner shall adhere to the approved trash removal plan <br />approved by the Director of General Services, which includes the continued use of six <br />(6) existing dumpsters. The dumpsters shall remain on concrete pads and be shielded <br />from view by vinyl fencing. <br /> <br />(d) The property owner shall be responsible the cost of providing water/sewer <br />services to comply with City standards, codes, and ordinances. The owner/developer <br />shall provide backflow protection to comply with City Code requirements. <br /> <br />(e) Proposed fencing and landscaping shall be reviewed and approved by the <br />Director of Planning. <br /> <br />(f) All signage shall be approved by the Zoning Official's office. <br /> <br />(g) The property owner shall obtain the appropriate permits through the Office <br />of the Building Official prior to performing renovations. <br /> <br />(h) All taxes and fees associated with the property and the project shall be <br />paid when due. <br />
