<br />February 14. 2006 <br /> <br />WHEREAS, the Governance Board of Empowerment 2010, at its meeting on <br />February 2, 2006, adopted a resolution recommending that the Councils of the Cities of <br />Norfolk and Portsmouth designate the Bonds as new empowerment zone facility bonds <br />for purposes of Section 1394(f)(2)(A) of the Code; <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia (the "Council"): <br /> <br />Section 1: That, relying upon the representations of the Authority, the recitals in <br />the preambles hereto are found to be true and correct in all respects and are adopted as <br />findings of this Council as if fully rewritten herein. <br /> <br />Section 2: That the Council designates the Bonds as "new empowerment zone <br />facility bonds" for purposes of Section 1394(f)(2)(A) of the Code. <br /> <br />Section 3: That the designation of the Bonds, as required by Section 1394(f)(2)(A) <br />of the Code, does not constitute an endorsement to a prospective purchaser of the Bonds <br />of the creditworthiness of the Project or the Applicant and the Bonds shall provide that <br />the City of Portsmouth shall not be obligated to pay the Bonds or the interest thereon or <br />other costs incident thereto and neither the faith or credit nor the taxing power of the <br />Commonwealth of Virginia or the City of Portsmouth shall be pledged thereto. <br /> <br />Section 4: That this resolution shall be in effect from and after its adoption, and <br />shall expire one (1) year from the date of its adoption." <br /> <br />Ayes: Heretick, Moody, Psi mas, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />06-86 <br /> <br />Adoption of a resolution authorizing the City Manager to execute an easement <br />to Columbia Gas of Virginia, along with such other documents as may be <br />necessary to provide Columbia Gas an appropriate area to replace an aging <br />gas main that serves surrounding subdivisions and businesses in the Victory <br />Boulevard/Fairwood Heights area. Vision Principal: Neighborhood and <br />Community Transformation. <br /> <br />Background: <br />. Columbia Gas has a gas main that currently crosses the Bide A Wee Golf <br />Course from the point where Military Road terminates at the eastern line of the Golf <br />Course at the 18th tee to the point where it exits the Course near the Pavilion at Bide A <br />Wee. <br />. The current main runs along and adjacent to the front side of the Pavilion, and is <br />very near the building. <br />. The current main was constructed around 1953, and there is some concern that <br />in the area of the Pavilion it needs to be replaced due to potential leaking. <br />. The new easement would provide for replacing the line from a point near its exit <br />from the Course at the north end of the Pavilion across the parking lot to reconnect <br />with the existing line near the Third tee. This would remove the line from any point near <br />the Golf complex buildings. <br /> <br />Discussion: <br />. Financial Impact: There will be no financial impact as a result of the replacing of <br />the section of gas main. <br /> <br />Staff Recommends: <br />Adoption of a Resolution authorizing the City Manager to execute an easement to <br />Columbia Gas of Virginia, along with such other documents as may be necessary to <br />provide Columbia Gas an appropriate area to replace an aging gas main that serves <br />surrounding subdivisions and businesses in the Victory Boulevard/Fairwood Heights <br />area. Vision Principal: Neighborhood and Community Transformation. <br />
