<br />January 24.2006 <br /> <br />It being the same property that was conveyed to First and Merchants <br />National Bank of Richmond, Virginia, trustee by deed of Park Plaza Corporation, <br />a Virginia corporation, dated February 11, 1977, and recorded in said Clerk's <br />Office in Deed Book 731, at page 75. <br /> <br />3. That the use permit is approved subject to the following conditions which <br />the applicant and any successor in interest shall observe: <br /> <br />(a) Hours of operation shall be limited to between 5:00 a.m. and 5:00 p.m. daily. <br /> <br />(b) No more than three tractor-trailers shall be received daily. <br /> <br />(c) No more than 20 cargo vans shall be utilized for deliveries. <br /> <br />(d) All sign improvements shall be in accordance with the City's Zoning <br />Ordinance. <br /> <br />(e) All outside HVAC or other equipment shall be screened by fencing and/or <br />landscaping. <br /> <br />(f) A buffer consisting of fencing and landscaping shall be installed between <br />the rear (southwest portion) of the site and the adjacent neighborhood. Fencing shall <br />be of a wood or vinyl material, as approved by the Planning Director. <br /> <br />(g) Ingress and egress for the property shall be by Hodges Ferry Road only. <br /> <br />(h) The applicant shall comply with all applicable codes, ordinances and <br />regulations of federal, state and local governments and shall obtain and maintain in <br />effect all required licenses and permits. <br /> <br />(i) All taxes and fees in connection with the subject property and the <br />proposed use shall be paid when due. <br /> <br />4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City CounciL" <br /> <br />Ayes: Heretick, Moody, Randall, Smith, Whitehurst, Holley <br />Nays: None <br /> <br />- Other Unfinished Business - <br /> <br />(a) UP-05-24 <br /> <br />CAVALIER MANOR NEIGHBORHOOD - Aziz Sair requests a use <br />permit to operate a gas station/convenience store/car wash at <br />3709, 3711 Victory Boulevard and 3706 Rapidan Street. Deferred <br />from the January 10, 2006 Council Meeting. Vision Principle: A <br />Robust and Prospering Economy. <br /> <br />Motion by Mr. Whitehurst, and seconded by Mr. Moody, to deny UP-05-24, <br />deferred from the January 10,2006 meeting, and was denied by the following vote: <br /> <br />Ayes: Moody, Randall, Smith, Whitehurst, Holley <br />Nays: Heretick <br />
